Gay Vets ask Court to Reinstate 'Don't Ask, Don't Tell' Lawsuit

GayvetsTwelve veterans discharged for being gay have asked the 1st U.S. Circuit Court of Appeals to reverse an April ruling by U.S. District Judge George A. O'Toole, dismissing their challenge to the military's 'Don't Ask, Don't Tell' policy.

The veterans, representing the Army, Navy, Air Force and Coast Guard, all served in the recent "war on terror" according to the Servicemen's Legal Defense Network, would like to be reinstated in the U.S. armed forces.

In arguments today, former Army Capt. James Pietrangelo II told the court: "Systematically in the military today, gays are being harassed, hounded, harmed. This is segregation all over again."

There was no immediate ruling from the court.

Marco - (Andy I hate to direct someone away from your site) You may want to go check out the responses (and the lack there of) Joe got out of Sanchez over at Joe.My.God (including the fact that Sanchez implies he is not gay -- interesting considering that he dated Andy)......this Sanchez thing really besmirches the good name of the Marines and other armed service people that put their lives on the line to protect us and follow our country's commander-in-chief (and his misguided war).

  5. You know no matter how hard I try I just cant seem to justify (im my mind at least) why the U.S. armed forces are so anti gay. I was learning about the topic on wikipedia and there is quite a long list of countries that have come to relize that we can fight just as hard as the striaght boys...

    But I guess just like how we gay americans are "destroying" the american family we must be destroying the american military... it is sad and I tryly hope that our leaders (or should I say future leaders?) will see that it is time to grow up and start really treating people farily... one can only hope...

  6. Nick it's the $24,000 question. I wonder too why America seems to have such an issue with its gay citizens when other industrial nations seem further along. I'm not a sociologist, but I would guess that it's tied into this country's standings in education compared to other industrial nations.

    You could also ask how a country that seems so hung up on prudish sexual puritanism can also use sex to sell everything from toothepaste to tires.

    And their in lies the answer. Sex sells. No question about it. So since a little skin really helps the profit margins I guess we can just turn a blind eye to it… now what I would like to see is some ‘gay’ sex selling stuff on TV wouldn’t that be ironic…

  8. this sanchez guy also has/had a web page devoted to his work as an escort while in new york. i would imagine the u.s. govt. is underwriting his education at columbia as that's how they do it depending on how long you were in the armed forces. makes me wonder what the need to supplement your income with escorting is for any way... this guy is obviously gay if he dated the host of this blog at one time. it's one thing to be gay-for-pay, and it's another to be "gay" in your personal life. it would seem this guy is keeping his sexuality hush-hush for fear he would lose all financing for his education by the govt. just a theory, mind you.

  9. I think we should have as many of these cases in as many circuits as possible. I believe that over time, as all the arguments for excluding gays from the military are put forth and discredited, the courts will reach a consensus that the ban on gays in the military is based on irrational prejudice, nothing else. This process may take awhile so its good to get started. We also may have to wait for some members of the U.S. Supreme Court (see Scalia and friends)to leave the Court, but the outcome is inevitable. There is no rational basis for excluding gays from the military.

  10. Nick the simple answer to why most people don't like gay people is ANAL SEX. They automatically think of that aspect and don't like it.

    For the sake of gay soldiers I want them to win. I don't agree that it be in the middle of war. Giving gays a pass during wartime has happened since WWI only to have strict anti-gay policies reinstated during peacetime. I also think training needs to be involved to help everyone get comfortable.

  11. Kids, the right to fight for your country.

    In all the years that I have had friends that are military or retired none of them are screamers.

    It is rare that they even talk about the military and I don't really think they want to talk about it. It's one of those things don't ask.


    The war today is not for the homeland it is for the A hole in Washington that started the whole thing. Just think George you ain't getting the oil period. With everybody over there what happens when something happens here think about it.

    Any one of our communities could be hit with no warning at all. Do we really want anything to happen? Rice is pushing her agenda and I truly think she is the cause of a lot of the problems that occur around the world.

    I still don't understand where the US thinks they can control the world by bulling countries around the world. We in Canada are going to Daylight saving time on Sunday for purposes of the US and the stock exchange and market. Can you believe that whether we like it or not. Playing into the US. Canada is being bought up by the US left and right. Companies are selling Canada to the US at half the price.


    Just a thought.

    Jack, it's not as simple as that and here's why. If it were as simple as that, then no country that has a large heterosexual population (um, all of them) would ever grant gays equality. But that has happened in Cananda, Europe, etc. So why doesn't ANAL SEX as you so aptly put it, bother those heteros?

  13. In those countries they are more open about sex. Countries that are not open about sex have a more negative view toward gay people.
