Peter Schulte, who represents the plaintiff, said he plans to argue that the U.S. Constitution dictates that states recognize contracts from other states."

  1. Regarding the Texas divorce case. I can't tell, but it appears the two men were residing in Texas when they married in Cambridge. In other words, they likely lied on their marriage application, since Governor Romney enforce the "1913 law" and the SJC upheld it for most states other than the very few that don't have DOMAs in March of '06. The law was repealed in '08, so folks can get married here, but they still won't be in their home states.

    These guys; marriage, was likely invalid from the start because it would seem they fraudulently filled out the application (the "I know of no impediments statement"). Did they not know about Texas's statutes? Their willingness to blithely ignore the law, or to think it didn't apply to them, is really quite silly. Did they really think a state that explicitly says they aren't married would let them enter a legal process reserved for married people?

    this says nothing about the wrongness of those particular laws. Come on, though.

  3. Um, the Attorney General of Texas doesn't get to "allow" or not "allow" a divorce. That's for the court to decide. The AG has obviously taken a position on it, but it's not binding.

  6. The whole Texas gay divorce thing just makes my blood boil! Here we are, not even getting marriage rights yet and these bozos are decrying their need for divorce! I find it juvenile and an epitome of the arrogance behind so much of the marriage movement that is doing such an excellent job of alienating (mostly) the straight people (and others). We should be proving we can handle marriage and make lasting commitments, not "fighting" to be able to divorce. If we can't stay married, why are we fighting in the first place??? Gah!!!!!!!

    Croatia is hardly the backwater some of you might think. They are very big on being part of Europe these days, especially in proving that they're more advanced than the rest of the Balkans.

    The word she used for faggotry is a very Balkan word: pederluk. It's derived from the slang for gay (peder) plus a Turkish suffix meaning sort of "neighborhood" or "everything having to do with x". The combination is quite spectacular.

    Actually, Marty, DIVORCE is something we ARE fighting for by fighting for marriage. Seems counterintuitive, but legal, valid, binding divorces are nearly as important as marriage. Divorce is an orderly dissolution of a couple's existence. It covers assets, earnings, and kids, including alimony and child support & visitation rights. Without divorce and its court stewardship, partners' separations may not be fair or equitable.

    There are countless examples of couples who split and the lower-earning member is not treated fairly. Divorce is a legal protection for BOTH members of a disolving couple. The right to divorce is an inherent part of marriage rights and the protections it offers are legitimate and important for same-sex and different-sex couples.

    In addition, I disagree that we all need to be perfect examples on behalf of the GLBT community. The Goodridges divorced, and they were the lead plaintiffs in the Massachusetts case. The women who got CU'd in VT and later separated, one went to VA and became a religious nut / "ex-" lesbian and tried to sue to block the VT-based partner from seeing their child? Were it not for divorce (or the dissolution of a CU, in VT), the VA woman could have completely prevented the VT woman from seeing the child.
