15-year-old Brandon McInerney pleaded "not guilty" Thursday to first degree murder and other charges in the shooting of his classmate Lawrence King in February 2008, the Ventura County Star reports:
"McInerney, 15, who is being prosecuted as an adult, was accompanied
by his attorneys in Ventura County Superior Court as he formally
received the criminal charges against him. His arraignment had been
postponed repeatedly since the February 2008 shooting. Ventura County Superior Court Superior Court Judge Bruce Young set a pretrial hearing for Oct. 23 and a trial date for Dec. 1. After the arraignment, Senior Deputy District Attorney Maeve Fox
said she doesn’t know whether McInerney will be tried in December. 'Your guess is as good as mine,' she said. McInerney’s lawyers, Scott Wippert and Robyn Bramson, filed a legal
motion Thursday to dismiss the special circumstance of lying in wait
that was tacked onto the felony criminal charges by prosecutors after a
three-day preliminary hearing."
According to the paper, a "lying in wait" circumstance automatically transfers the case from juvenile to adult court. Since McInerney is being tried as an adult already, Fox argued that the point is moot. Prosecutors have offered a 25 to life deal if McInerney pleads guilty to first-degree murder and a hate crime. McInerney faces 53 to life if he refuses.
Well, lets hope this will be be a speedy conviction.
With the amount of press this had, it would be surprising to have this kid not come out with some kind of conviction.

This kid has some pretty shitty lawyers; if you're one to believe in rehabilitation, 25 (or more) years is a hell of a plea for shooting someone in a classroom full of people...

The U.S. no longer executes minors...the Supreme Court said it made us look uncivilized to the rest of the world. Instead the little shit will spend 25-53 years of his life in an 8' X 8' concrete box being passed around like a bottle of cheap wine...so much more merciful than euthanasia (lethal injection).

This kid should NOT be tried as an adult. We want to send this homophobic kid to prison (a place so notoriously homophobic that it has made gay rape a JOKE) for rehabilitation? Yeah. That'll work. What could possibly go wrong?
Sending someone to prison is not about revenge. It IS about the convict's rehabilitation. If this kid is homophobic enough to shoot someone, I think he's unlikely to change in our prison system.

Nope. Not revenge or rehabilitation. It's about justice and punishment. Rehabilitation actually is not a prominent feature in the U.S. criminal justice system.

So, if convicted he'll be put into juvenile detection until 18, then be moved to a prison. Personally, I think he'll flourish.
Think about it. He'll probably get sexually abused/raped for a year or two, securing his hatred for gays. During that time, every spare minute he has he'll be working out. By his early 20s, his body will be all muscle and his hatred for gays and likely all minorities will be well established. Then the white supremacy people will take him under their protection. After which, he'll live a carefree life in his little corner of the world. And be free to beat the crap out of or flat out kill every gay brought into his prison. He has nothing to lose.

He should receive a life sentence with out the possibility of parole. I think that would be just punishment for the crime he committed. He shouldn't be allowed back into society to kill again. His homophobic beliefs aren't likely to change in prison.
My cousin is currently serving a life sentence for the brutal robbery and murder of an older gay man committed by him and a friend back in the seventies. My cousin is a homophobe and is exactly where he belongs. I truly believe that if he were paroled tomorrow he would kill again.
