Watch: Elena Kagan Talks About Her Nomination

The White House yesterday rolled out a video to introduce its Supreme Court nominee, Elena Kagan. Kagan discusses her background, experience, and current position:

"Nobody knows quite what [Solicitor General] means. Some people think it's the people who put the labels on the cigarette packages. But, in fact , it's not. That's the Surgeon General. The Solicitor General is the person who represents the United States in the Supreme Court. We participate in about three-quarters of the court's cases. Each time the court sits I'll appear in court..."

  1. The right is going to bait Kagan mercilessly. But what the right wing thinks about Kagan is unimportant. What we think is all important.

    The only reason Obama nominated Kagan is because she's a loyal lapdog of big business and militarism, just as he is.

    For instance a new article in AlterNet says she "helped protect the Saudi royal family from lawsuits that sought to hold al Qaeda financiers responsible in the wake of the Sept. 11, 2001 attacks.

    The suits were filed by thousands family members and others affected by the Sept. 11 attacks. … But Kagan, acting as President Obama's Solicitor General, argued that the case should not be heard even if evidence proved that the Saudis helped underwrite al Qaeda, because it would interfere with US foreign policy with the oil-rich nation." http://www.alternet.org/rights....._lawsuits/

    Her sexuality is her business and hers alone. But if she's closeted she's a danger to us all. The Democrat Party is the last closet, the political closet. It warps those who tarry too long. It's a closet that teaches them first to compromise and then to betray.


    Since DOMA and DADT continue to define the Democrat Party what we need to know from Kagan is not who she goes to bed with. We want to know what she'll do about DOMA, DADT, ENDA and etc.

    She's not saying. Perhaps that's a good career move but if she won't clear up the mystery she can't be counted on.

  2. Well BILL, you seem to have chosen carefully: what someone argues as Solicitor General is not really indicative of what they'd do as a Supreme. From the same publication is a more informative discussion of her background:

    She is described as the one who can woo Kennedy to the "right" (i.e., left) side. Further, Lawrence Lessig describes,
    "I spent four years sitting across the table from Elena Kagan three days a week listening to her spout very strong and, in my progressive views, very correct views about a wide range of constitutional issues. She’s written substantively about the First Amendment, which is an extremely important part of the Supreme Court’s jurisprudence.

    "And contrary to Glenn’s characterization, her views about the president’s power, in the presidential administration article, are views that liberals and progressives should embrace, because they are exactly contrary to the view of the right-wing Bush-Cheney doctrine that says the president can do whatever he wants, Congress be damned. Her view is the president has this power, but only so long as Congress grants that power to the president."
