Arkansas Attorney General Accepts Language for Ballot Measure Repealing Gay Marriage Ban

Arkansas Attorney General Dustin McDaniel has accepted language for a proposed 2014 ballot measure submitted by Arkansans for Equality that would repeal Constitutional Amendment 83, which prohibits same-sex marriage, KARK reports:

McdanielMcDaniel issued the opinion Thursday afternoon, which states that the amendment, if passed, would not make same-sex marriage or civil unions legal in the Natural State, but would grant power to the General Assembly to pass laws relating to same-sex marriage.

In the opinion, McDaniel iterates that the purpose of his review and certification is to ensure that the popular name and ballot title "honestly, intelligibly, and fairly set forth the purpose of the proposed amendment or act."

McDaniel also remarked on another proposal he said had "deficiencies in the proposal's ballot title and text." That proposal would amend the state's constitution to recognize the marriage of two people regardless of gender.

  6. So the state makes gay marriage illegal through a constitutional amendment, but the AG refuses to allow it to be legalised through a further constitutional amendment.

    Instead he insists on language that gives the state legislature the right to legalise gay marriage, not the people.

    Democracy? I think not, it's the Repubs wanting to delay rights for gays. Again!

    You can contribute to that happening by supporting the main groups in Arkansas that are working for it.

Our mission is to oppose all legislated discrimination in Arkansas. Our first goal is to remove Arkansas Constitutional Amendment 83 which prohibits marriage equality and civil unions. After that (and only after that) can we then address the 3 other laws currently on the books banning marriage equality. We are pleased that there are currently 2 lawsuits (one state, the other federal) addressing this discrimination, but we acknowledge that lawsuits could take years. Rather than rest on our laurels waiting for our rights, we choose to stand and demand action now. Please join us in out fight.

  10. How could anyone reasonably equate the unnatural, fruitless marriage of two members of the same sex to the natural marriage of a man and woman? One should reach the conclusion that they are not equal without considering the blasphemy aspect of homosexual unions. The last-resort argument of same-sex marriage proponents is to equate the sodomitic sexual practices of homosexual unions to those between men and women. Nevertheless, they are morally different in that the generative attraction and passion that initiate homosexual unions is unnatural. Consequently, unlike in relationships between men and women that may grow perverse, the very foundation of homosexual relationships is offensive to God.
    I agree with those who say that government should not concern itself with what consenting homosexuals or anyone else of legal age does in private, but it should only legitimize homosexual relationships under legal contracts—domestic partnerships. Government should not honor same-sex unions by calling them marriages, which is a term that connotes a religious meaning. Marriage is a God-sanctioned union between men and women. God would never sanction what He refers to as an abomination in His eyes. More than 90 percent of Arkansans are members of one of the three Abrahamic religions, all of which have tenets condemning homosexuality. To honor such unions by calling them marriages, blasphemes the God of Christianity, Islam, and Judaism for the sake of the few unbelievers. Arkansas' constitution is correct as it stands.

    I found your remarks troubling.

    I guess your church doesn't allow elderly or infertile couples to wed? Such "inferior" marriages must indeed be a "perversity," ... unless you're just being hypocritical.

    But, sir. The State of Arkansas recognizes marriages between atheists. Obviously these couples' marriages have no religious meaning at all. For that matter, since Christianity claims that no other religion offers salvation, marriages between Jews, Mormons, Buddhists, Hindi, etc. must be equally invalid marriages... right?

    God also considers the following to be abominations: catfish, polyester/cotton blended shirts, you shaving your beard, etc. You have read the Bible, right? In particular, you have read the book of Leviticus, right? It seems you are unaware of your Holy Book.

    Again, unions between atheists are honored by the title of "marriage." Why not offer basic human rights to all people? Mr. Sebastian, why don't you love your neighbor as Jesus commanded you (Mark 12:31)?
