New York Removes Surgical Requirement for Changing Gender on Birth Certificates

New York Governor Andrew Cuomo's office announced today that no longer would transgender people have to prove reassignment surgery to make a gender change on their birth certificate, Reuters reports:

CuomoUnder the policy, a transgender person will still need to provide a notarized affidavit from the doctor treating them for what the American Psychiatric Association calls gender dysphoria, previously known as gender identity disorder, in order to get their birth certificate modified.

But under the policy the doctor will no longer need to affirm that their patient has had surgery, only that they are receiving "appropriate treatment."

The Empire State Pride Agenda applauded the move:

“This is tremendous news for New York and especially for the transgender community, and a great step forward to ensuring many transgender New Yorkers no longer need to undergo a process they not wish to in order to receive an identity document that truly reflects who they are,“ said Empire State Pride Agenda Executive Director Nathan M. Schaefer. “This is an issue we’ve been advocating for the past several years and are grateful for Governor Cuomo’s leadership and the Department of Health for moving us closer to equality and justice for all New Yorkers.”

“Under Governor Cuomo's leadership, New York is reclaiming its rightful place as the progressive capital of the nation and made significant progress to advance the rights of all New Yorkers, including members of the transgender community. Much work remains and this administration is committed to promoting laws and policies that are fair and just for all,” said Alphonso David, Deputy Secretary for Civil Rights for New York State.

  7. I used to run around NYC with lip gloss and a lip brush when I was 21. I eventually detoxed with Chapstik. I'm so relieved they didn't have this new law then. I was so pretty, I might have altered my birth certificate to match me -- having no grasp of the concept "phase" at the time.

  12. Lol! This is the great victory of the Empire State Pride Agenda. Go and check out their latest public IRS filing. They are collapsing. Their revenue has fallen off a cliff. They delayed the filing as long as possible, but eventually the truth came out. Apparently, LGBs who used to send millions to the group are not particularly interested in the weird tranny crusade against the "gender binary" and have opted to fund more worthy causes. Of course, the trannies themselves don't fund ESPA because there aren't many trannies in the world and those that do exist are largely not employable outside the fetish sex industry.

    How sad that yet another LGB group has drunk the Kool Aide of tranny activism and has destroyed itself.

  13. What is Gov Cuomo going to do for the neutrois? They are the part of the Trans circus, um, I mean community, who insist that they have no gender and who want to castrate themselves to make their bodies genderless.

    I think these neutrois Ts must have their rights!! Their state IDs should say neither male nor female, but should just have an icon of a meat cleaver, the symbol of the neutrois.

It's almost like they have no self-awareness of how much they sound like the far right: Using the fringe to try to discredit a community? Check.     I don't think you can provide evidence to correlate their financial problem with the trans issue. Since New York has not much left in the "gay agenda", it is natural people assume that they don't need donation to fight political battles any more. It is great irony that when gay people get all their rights, all the gay and anti-gay organizations will lose their relevance and reason to exist any more.

    What you said is exactly my point. ESPA was always a gay org. The idea of LGBT is a fiction. Whenever LGBT is put to a real-world test, it fails. Here, ESPA accomplished its main LGB legislative goals and it decided to make trans issues its main focus. If LGBT were real, the money would be there for ESPA.

    But LGBT isn't real and LGBs - with real lives to lead - do not care about the pooping dilemmas of straight transsexuals or the wacko issues of poly genderqueers and neutrois. It is a far better thing to donate to the homeless or to help stop the appalling treatment of dolphins in Taiji, Japan than to send money to procure taxpayer-funded butt implants for incarcerated transgender murderers.
