9th Circuit Denies NOM Request To Halt Gay Marriages In Oregon: READ

OregonThe 9th Circuit Court of Appeals has blocked a request from the National Organization for Marriage (NOM) to halt gay marriages in Oregon, The Oregonian reports:

The action comes in the wake of the May 19 decision by U.S. District Court Judge Michael McShane in Eugene to strike down Oregon's ban on same-sex marriage. Voters in 2004 passed an amendment to the state constitution, Measure 36, defining marriage as between one man and one woman.

Supporters of same-sex marriage applauded Wednesday's decision.

"We're thrilled by the news but not surprised at all," said Jeana Frazzini, executive director of Basic Rights Oregon. "There was never any merit to their proposal and they've been denied now at every turn."

Frazzini read the court's decision and called it "decisive."

NOM can now either appeal its case to the full 9th Circuit (a three judge panel issued today's decision) or the U.S. Supreme Court. The Court previously denied a request from NOM to get involved in the case back in June. Should NOM appeal to the Supreme Court, the justices would have another chance to intervene.

  4. At this point, Mr. Brown and his ilk know that they have no winning or valid arguments to support unconstitutional bans denying fundamental rights to same sex couples. The only thing Mr. Brown is defending at this point is his six figure income and "job". His main job is to milk anti gay donors for millions of dollar, which he has been successful at. In turn for this money he's collected, he's supposed to fend off gay marriage. He has not been very successful at that for the past few years. He also has not been successful at stemming the rising support for Marriage Equality from the American Public. Poll after poll now indicate that a Majority of Americans support Marriage Equality. A large part of this support, I believe, is due to social media, education, and people living openly gay. We can do this now because of Anthony Kennedy's landmark ruling in 2003's Lawrence decision. Because of Facebook, people now KNOW, gay people, and know they have gay friends and gay family. The HRCs red equality sign campaign on facebook was brilliant. People were able to see at a glance their gay friends, family or gay supportive friends. People see now that the people they know love and are friends with are not the stereo types that NOM and the anti gay crowd like to portray us as. We are not just the half naked boa wearing, dancing parade attendees, or the white face pregnant drag nuns that they like to portray us all as on TV. America now knows that gay people are their friends, family, neighbors, bankers, soldiers, police, doctors, legislators, cashiers, mailmen. And don't we all in America love a nice wedding party with a DJ and an open bar :D. I hope we'll see Brian Brown in an unemployment line by this time next year.

  6. Apparently the two denials are different.
    The first denial by the Supreme court in June was for the halt of marriages in Oregon.
    The current denial by the appeal court is for granting NOM standing to intervene.
    They are just making a fool of themselves if they appeal this again to the Supreme court.

  9. National Organization for Marriage .... hm ... how come it doesn't support ALL marriages? What in NOM's reasoning makes male-female marriage preferable to same-gender marriage? They've yakked and yakked about children, but that argument is so full of holes it's not even funny. It would be far more honest of this organization to state plainly that they hate homosexuals.
