Anti-Gay Flagstaff Attacker Charged with Felony Assault

You may recall an incident in June in which two men, one of whom was a worker for Equality Arizona, were assaulted outside a Pita Pit restaurant in downtown Flagstaff, Arizona following the city's "Pride in the Pines" festival. Four attackers were arrested at the time.

FlagstaffNow one of them, 24-year-old Travis Reiner, has been charged with one felony count of aggravated assault and misdemeanor counts of assault and disorderly conduct.

The Arizona Daily Sun reports: "According to Flagstaff police reports, two men who had attended the festival were injured early Sunday morning when they were assaulted while waiting for a taxi on the corner of San Francisco Street and Aspen Avenue. Festival events at Wheeler Park had ended Saturday evening, but many attendees moved to special event venues hosted by downtown businesses. One of the victims, who is gay, was briefly hospitalized after being knocked unconscious."

Although anti-gay slurs were used and police called it a hate crime, "David Rozema, chief deputy Coconino County attorney said in a statement that Arizona no longer has a separate hate crime law."

Added Rozema: "However, evidence that a crime is committed with malice due to a victim's sexual orientation (among other things) can possibly be presented at trial as motive evidence and at time of sentencing, upon conviction, to seek a stiffer sentence."

Charges are still pending for the other three attackers.

road.jpg Arizona Governor Janet Napolitano came out against amending her state's Constitution to outlaw gay marriage. "I believe marriage is between a man and a woman. I don’t think the constitutional amendment is necessary. The voters of Arizona will have a chance to decide this. Personally, I’m going to oppose it. We already have a statute that defines marriage. The courts have already said the statute is constitutional."

Arizona Senate May Reconsider Marriage Ban Soon

Yesterday I posted that the proposed ballot measure that would put a constitutional ban on same-sex marriage before Arizona voters had been rejected in the Arizona senate by a 14-11 vote. I mentioned also that the senate voted to reconsider the measure at another date.

ArizonaflagTurns out that date could be as early as Friday:

"When it became apparent the proposal had just 15 votes, one fewer than it needed, Phoenix Republican Sen. Linda Gray — a supporter — switched her vote in a procedural move that will allow her to request the measure be brought back for reconsideration in the waning days of the legislative session. That would give another supporter, Sen. Karen Johnson, a Mesa Republican who is on vacation, time to come back and vote. The surprise roll call Wednesday, which had been weeks in coming, quickly spun into a heated debate over marriage and 'social norms.' It took place even though supporters knew it would be difficult to rally enough votes with Johnson absent. Three other senators, including Tucson Democrat Victor Soltero, were absent, but opponents of the measure say all three are against it...Supporters blamed Johnson for the failure, without naming her directly. Johnson, however, in a Senate memo Monday, indicated she expected the marriage referendum vote to come on Friday and would 'make a special effort' to return for it even though she planned to be gone through July 10."

Arizona Senate Rejects Ballot Measure to Ban Same-Sex Marriage

ArizonaflagIn a 14-11 vote, the Arizona senate today rejected a measure that would have placed a constitutional ban on same-sex marriage in front of voters in the November elections:

"Senators later voted to reconsider the measure at another unspecified date. The proposal would define marriage as a union between one man and one woman. Supporters say the proposal would provide additional legal protection needed to prevent marriage from being redefined by a court or future lawmakers. Opponents argued that the existing law makes the amendment unnecessary and that it insults gays and represents an attempt to exploit marriage for political purposes."

Four Arrested After Anti-Gay Assault at Flagstaff, Arizona Pride

Two men, one of whom was a worker for Equality Arizona, were assaulted outside a Pita Pit restaurant in downtown Flagstaff, Arizona following the city's "Pride in the Pines" festival. The attackers preceded their attack with anti-gay slurs, according to the Arizona Republic:

Flagstaff"Authorities found four suspects and took them into custody after interviewing them. The four suspects were: Travis Reiner, 24, of Flagstaff; Christopher Rose, 26, of Englewood, Colo.; Michael Van Roteyn, 24, of Flagstaff; and Mark Greinke, 25, of Sun City. The four suspects could face charges of aggravated assault, assault and disorderly conduct, and they could also be charged under hate crimes statutes, police said. According to a statement from Equality Arizona - an advocacy organization for lesbian, gay, bisexual and transgender people - one of the injured, Michel Brown, was unconscious and bleeding after the attack. At the time of the attack, the injured person waiting for a cab alongside staff and volunteers from Equality Arizona, the statement said."

Said Barbara McCullough-Jones, the Executive Director of Equality Arizona: "On a day when all of Flagstaff should have been celebrating and embracing diversity, this brutal attack has reminded us all that there is still much work to be done to prevent anti-gay bias from escalating into violence."

Change of Heart Bears Fruit for Once-Biased Scottsdale Bar Owners

Last December I posted about Scottsdale bar owner Tom Anderson's decision to convert his bar Anderson's Fifth Estate to a bar that serves the gay community after making headlines in 2006 when he banned a transgender woman following complaints she was using the women's bathroom.

ScottsdaleIn December, Anderson said he had decided he wanted to "change Scottsdale" after a number of high-profile anti-gay hate incidents there. He also saw a need in the nightlife community for a new gay venue.

Anderson's decision seems to have paid off. The club, which now has lines it never saw before, was lauded in the Arizona Republic over the weekend, and tells the story of Anderson's transformation after the unfortunate 2006 incident:

"For more than a year afterward, Anderson was the subject of dozens of newspaper and television stories pitting him against the GLBT community and its allies. He became known as the club owner who kicked out a transgendered woman. This happened as people were questioning whether Scottsdale was becoming hostile toward the GLBT community, after a gay couple was assaulted outside a restaurant and after Mayor Mary Manross refused to observe GLBT month in June, instead, proclaiming it to be Human Relations Diversity Observance month. Anderson, who owns the club with his wife, Roberta, resolved the dispute in November 2007 by building a gender-neutral restroom. Anderson said that during the controversy over the discrimination complaint he met with members of the GLBT community. One of the things he learned was how underserved the community was in Scottsdale, with only one bar, BS West, in the area. Anderson said he saw both a business opportunity and a chance to be part of a community he'd come to know and enjoy. The Andersons reopened the club as Forbidden in December, a month after the resolution. The 5,500-square foot club can hold 325 people and is open five days a week, up from three when it was Anderson's Fifth Estate. Now, more than 700 people come through on Fridays and Saturdays each, more than double what Fridays used to draw."

Phoenix Man Claims Responsibility for UFO Mystery Lights

Mysterious red lights similar to an unsolved phenomenon from 1997 appeared over Phoenix Monday night:

"Dozens of listeners called News/Talk 92-3 KTAR just after 8 p.m. reporting they were watching the four mystery lights. 'From my position, it looked like they were just hanging, not moving at all,' said one man, who called 92-3's 'Gaydos After Dark.' He said he 'absolutely' saw something. A woman caller said, 'It looked like four red tower lights, but it was pretty high up in the air. I called my husband and he said, 'Get home, what's wrong with you?'' A man in north Phoenix told CBS-5: 'They were about 3,000 feet high, approximately. They looked as though they were kind of hovering or floating from west to east, very slowly. They were up there for 15 or 20 minutes.' Those who saw them said the lights were visible about 13 minutes before moving off to the east. Deer Valley Airport, which was the closest air field to the lights, had no explanation for them. Neither did Phoenix Sky Harbor International Airport or Luke Air Force Base, which said it had no jets flying at the time."

Plenty of video surfaced but the source remained unknown.

Today, a local man claimed the lights were his doing: "The man told KTVK-TV that he used fishing line to attach road flares to helium-filled balloons, then lit the flares and launched them a minute apart from his back yard...The man told KTVK-TV that he used fishing line to attach road flares to helium-filled balloons, then lit the fares and launched them a minute apart from his back yard."

New Bid to Ban Same-Sex Marriage Moves Forward in Arizona

The Arizona House gave preliminary approval to a new bid to ban same-sex marriage. A similar measure was defeated earlier this month after Kyrsten Sinema (D-Phoenix) attached a clever provision to it that would have made a vote against same-sex marriage also a vote for other rights for unmarried (and gay) couples.

ArizonaflagThe Arizona Daily Star reports: "This time, though, Rep. Kyrsten Sinema, D-Phoenix, did not offer that same amendment. Cathi Herrod, president of the Center for Arizona Policy, said her group had lobbied to find enough votes to kill the amendment. A final House roll-call vote scheduled for later today will send SCR 1042 to the Senate, which has not yet debated the issue this session. The procedure maneuver used by supporters of the new version of the gay-marriage ban effectively blocks opponents from trying to amend the measure in the Senate."

Sinema refused to comment on what strategies she might have up her sleeve to derail the measure this time. Let's hope she has one.

Arizona Domestic Partners Approved for Benefits

Good news for domestic partners and their dependents in Arizona:

Arizonaflag"The Governor's Regulatory Review Council, which has the final say over many agencies' proposed rules, voted 4-0 to approve changes floated by the Department of Administration with support from Gov. Janet Napolitano, a Democrat. Some Republican legislators opposed the move. Dependents of domestic partners also will qualify. Employees will be able to sign up for benefits as of Oct 1. Supporters said providing benefits to partners and their dependents would help the state reduce costly turnover by being more competitive in recruitment and retention. Napolitano, among others, has argued that it was a question of fairness. In her first year in office, Napolitano issued an executive order banning discrimination in state personnel practices based on sexual orientation."

In early February, Arizona lawmakers reintroduced legislation that would constitutionally ban same-sex marriage in the state. In 2006, voters rejected a similar measure because it went too far, prohibiting domestic partnerships and civil unions.

road.jpg Pentagon will shoot down disabled satellite before it poses danger to Earth: "U.S. officials said Thursday that the option preferred by the Bush administration will be to fire a missile from a U.S. Navy cruiser, and shoot down the satellite before it enters Earth's atmosphere. The officials spoke on condition of anonymity because the options will not be publicly discussed until a later Pentagon briefing. The disabled satellite is expected to hit the Earth the first week of March. Officials said the Navy would likely shoot it down before then, using a special missile modified for the task."

Arizona Lawmakers Propose Ban on Same-Sex Marriage

Arizona lawmakers proposed a constitutional ban on same-sex marriage Monday:

Arizonaflag"The proposal was backed by 16 of 30 state senators, and an identical proposal was introduced in the House. Both chambers would have to approve the measure in a vote for it to be included on the ballot. Under the amendment, 'only a union of one man and one woman shall be valid or recognized as a marriage in this state.' The proposal comes after Arizona voters narrowly rejected a similar measure in November 2006."

A similar measure in 2006 was rejected by voters because it reached too far, including prohibiting domestic partnerships and civil unions.

Said State Rep. Kyrsten Sinema (D-Phoenix): "I don't think it's needed. I don't think it's necessary. We've already had this fight a couple of times."

Arizona Woman Gets 10 1/2 Years for DUI Death of Gay Cyclist

A sentence handed down in the case of a woman who struck a gay man on a bicycle while she was drunk, killing him, is getting attention in Arizona. Melissa Arrington might have received as little as four years behind bars but the judge gave her six and a half more because of a taped phone call she made from jail two days after the accident.

DuiMark Kimble of the Tucson Citizen reports:

"Less than 11 months earlier, she had been arrested and charged with DUI. She was sentenced to two days in jail and 18 months of probation. Her driver's license was revoked. Nonetheless, on that Friday evening in December 2006, she left the bar to drive home. A woman driving behind her saw her run off the road several times. On the far East Side, Arrington turned onto Old Spanish Trail. She again drifted off the road several times. The final time, she was so far off the road that she hit L'Ecuyer with the driver's side of her truck as she tried to get back on the pavement. He was thrown into the bed of her pickup, where he died. When she was sentenced Tuesday, Arrington received close to the maximum prison time permitted. Cruikshank said that was partially because of the lack of remorse she exhibited in a telephone call from jail two days after the accident. The call, as are all calls to and from inmates, was taped, and it was played in court at Arrington’s sentencing. On it, a male friend congratulated her on killing L’Ecuyer and told her she deserved 'a medal and a f---ing parade because you took out a (slur for a gay person), a cyclist, a tree hugger and a Frenchman in one shot.' Arrington's response, captured on the tape, was to laugh. Cruikshank called that 'breathtaking in its inhumanity.' Now Arrington says she is ready to be remorseful - serving her sentence, turning her life around and working on her idea for her own anti-DUI group."

Lake, of John Street, Southampton, has already been given a community punishment order for her role in that attack. She has now been sentenced to a six-month prison sentence, suspended for two years, for further harassment and abuse against the couple. Lake, along with a 15-year-old girl who cannot be identified for legal reasons, denied charges of harassment relating to eight incidents but magistrates found them guilty following a trial."

Nine years after Mark Truesdell, 29, was slain in his North Campbell Avenue apartment, Ronnie Gene Sartin Jr., 30, is being tried on a first-degree murder charge. Sartin was living in Tucson at the time of the slaying. Sartin was convicted by a jury in 1999 of first-degree murder and sentenced to life in prison. The Arizona Court of Appeals ordered the case returned to Superior Court last year for retrial after changes were made to the law regarding how premeditation is explained to jurors."
