In May, UK Gay News reported that campaigning by activists led to the successful repeal of a similar ban by Russia.

Russia Ends Ban on Gay Blood Donation

A two-year campaign by activists came to a successful end yesterday when the Russian Health Ministry ended a ban on blood donation by gays, according to UK Gay News:

Moscowactivistblood"Tatyana Golikova, the Minister of Health and Social Development signed the decree on April 16, it emerged yesterday. The decree amends the rules on blood donations which were implemented on September 14, 2001. According to the amendments, provisions for absolute ban on blood donations by people from the so called groups of high risk (homosexuals, drug addicts and prostitutes) are being repealed. Activists at GayRussia have been campaigning against the ban since April 2006 when they sent a letter to the Ministry of Health and Social Development as well as to the Russian General Prosecutor asking for the repeal of the ban because it contradicted the Russian Constitution and federal legislation. They repeated their demand a year later. The Ministry responded twice to the activists, saying that the amendments will be implemented, and that the issue is being discussed within the Ministry. A third letter was sent to the Ministry last month. Nikolai Alekseev and Nikolai Baev reminded officials that 'since May 1993 homosexual relations between consenting adults in private are not considered a crime in Russia. Since 1999 Russian psychiatry does not consider homosexuality as a mental illness as it joint international classification of mental illnesses'."

Kassing announced his decision to end blood drives in a Jan. 31 email to students. 'I recognize the importance of giving blood and we know that universities are significant sources of blood . . . however lacking further action by the FDA, we are guided by the clear mandates of our non-discrimination policy,' Kassing said in the email.

Canada Bans Sexually Active Gay Men as Organ Donors

Some patients in need of critical organs may be out of luck because of a discriminatory ban put in place by Health Canada that mirrors the restrictions placed on gay men from giving blood. The regulation, which went into effect in December, bars organ harvesting from gay men who were sexually active.

OrgandonationThe Toronto Star reports: "The regulation, which took effect in December and closely resembles blood-donor guidelines, prohibits organ donations from sexually active gay men, intravenous drug users and hepatitis victims. Both strictures are unfair to thousands of conscientious gays, says Dr. Philip Berger, head of family and community medicine at St. Michael's Hospital. 'What about a gay monogamous couple, (Health Canada) is not going to let them donate? It's ridiculous,' says Berger. 'It's been known for 20 years that the risk factor is not in being gay (but) in risky sexual behaviour.' Berger says 'it's what the individual does in their sexual lives, whether gay or straight, (that) puts them at risk. To exclude bona fide donors because they've had sex with another man ... would exclude a lot of people who are no risk at all. Zero risk.' Berger says the 'unreasonable' restriction is bound to reduce the supply of transplant organs at a time when the need is growing more urgent."

Dr. Gary Levy, head of Canada's largest organ transplant program, told the paper that the new regulation simply "formalizes" precautions that have been in place for many years. He said that transplant surgeons "will continue to make the final decision on which organs are suitable for use."

The paper adds: "Under the new regulation, however, surgeons will have to sign a form stating they authorized the use of an organ that would normally be excluded. In the vast majority of organ donation cases, sexual history is assessed through interviews with relatives of the deceased. Even if a donor card has been signed, the family or the courts must give permission for harvesting in Ontario, Levy says. But Berger says the Health Canada regulation is fundamentally flawed because the organ harvesting system depends entirely on the goodwill and honesty of donors or their families. He adds that current HIV screening tests can confirm the infection-free status of donated organs rapidly and with virtual certainty. The only risk would come from donors in the 'so-called window period when they've been recently infected,' Berger says, calling that an 'infinitesimal' worry. However, Levy says HIV can incubate for 20 days or more before becoming detectable."

Activists Arrested at Moscow Demonstration Over Gay Blood

Ten people, including the leader of Moscow's Gay Pride movement, Nikolai Alekseyev, demonstrated outside the Ministry of Health and Social Development building in Moscow late last week, and seven were arrested.

MoscowactivistbloodThe activists were protesting Russia's law prohibiting the donation of blood by gay men, a policy echoed by various governments around the world, including the United States.

Russia Today reports: "Mr Alekseyev says its unfair to compare gay men to drug users and sex workers, pointing out that there is no law preventing gay women from giving blood. He added that the health service is desperately short of blood, yet it is 'stopping people giving blood for reasons that are incomprehensible.'...Mr Alekseyev questioned the legality of the arrests, saying there was no trouble at the demonstration and that the protesters 'didn't interfere with anyone.' Alekseyev added that the protest was in no way connected to politics or the inflammatory Gay Pride parade, which takes place in Moscow every summer. He insisted Friday's action was meant only to show the discriminatory nature of the law."

FDA Upholds Blood Ban For Gay Men

The Food and Drug Administration announced yesterday that they would continue a policy created during the AIDS crisis in 1983 that prohibits any gay man who has had sex with another man since 1977 from donating blood. Those that have are permanently banned from donating because the FDA sees them as having an increased risk of transmitting HIV through blood transfusions.

BloodAccording to the Associated Press, "In March 2006, the Red Cross, the international blood association AABB and America's Blood Centers proposed replacing the lifetime ban with a one-year deferral following male-to-male sexual contact. New and improved tests, which can detect HIV-positive donors within just 10 to 21 days of infection, make the lifetime ban unnecessary, the blood groups told the FDA. In a document posted Wednesday, the FDA said it would change its policy if given data that show doing so wouldn't pose a 'significant and preventable' risk to blood recipients. 'It is a way of saying, 'Whatever was presented to us was not sufficient to make us change our minds,'' [Dr. Celso Bianco, executive vice president of America's Blood Centers] said. The FDA said HIV tests currently in use are highly accurate, but still cannot detect the virus 100 percent of the time. The estimated HIV risk from a unit of blood is currently about one per 2 million in the United States, according to the agency."

Added Bianco: "I am disappointed, I must confess."

Hate in the Mail for Gay Would-Be High School Blood Donor

Ronnie Childers, the senior class president at Harbor High School in Santa Cruz, California, has received at least 50 hate letters since complaining about the Red Cross' policy banning gays from giving blood during a blood drive at the school late last year.

HarborhighChilders complained about the rules, established by the Red Cross in the 80's when officials feared that blood samples could be contaminated with the AIDS virus, after being denied the opportunity to donate.

According to the Santa Cruz Sentinel, "Some of the letters sent to Childers deride gay people as 'evil' or admonish him to 'think about it. Sex with the same sex is weird and sick' Some were sent from the area as evidenced by local postmarks." Said Childers: "There are a couple key phrases [like], 'I know where you go to school.' I think adults need to understand that letters like this are inappropriate."

The school stands behind Childers, with the principal saying the school will be lobbying lawmakers to get the outdated donation rules changed: "We're going to put together some kind of letter. And instead of sending it directly to the FDA, where it will get ignored, we're going to start hitting federal and state legislators. Because if the state Legislature also gets behind this then maybe they'll listen."
