NOM Chair: Supreme Court Rulings on Marriage Equality are 'Judicial Tyranny' -- VIDEO

National Organization for Marriage Chairman John Eastman went on CNN's State of the Union yesterday morning to rant against--ahem, discuss--last week's Supreme Court rulings on marriage equality.  Suffice it to say, he is not happy:

Well, it is a state-by-state battle, and I think he had one aspect of the state-by-state battle that is legitimate, which is to try and persuade people to make this change through their legislatures.  But he had a threat behind that: if the legislatures don't do that, we're going to have the courts impose this on them whether the people want it or not.  

Earlier you said that 12 states had voted to change the definition of marriage.  Well that's not true.  Half of them have--less than half of them have; the others have had it imposed on them by the courts.  This question is clearly not answered in the Constitution of the United States, and we are manufacturing a right to redefine marriage and impose it no matter whether the state or the country wants to have that definition.  That's judicial tyranny.

For a law professor (he teaches at Chapman University School of Law), Eastman doesn't seem to have all that much respect for the judicial process.

David Boies: SCOTUS Declared All State Gay Marriage Bans Unconstitutional — VIDEO

Proposition 8 attorney David Boies appeared on CNN's State of the Nation with Candy Crowley this morning to discuss the Supreme Court's rulings and the push for marriage equality nationwide.

Said Boies:

“First, remember that that the United States Supreme Court found that the plaintiffs in this particular case had standing to attack Proposition 8, but the people who were supporting Proposition 8 did not have standing to appeal our victory in the trial court,. So that reinstates the trial court's decision that says that all bans on gay and lesbian marriage violate the equal protection and due process clauses of the 14th Amendment.”

Crowley asked Boies if it's not now a states rights issue:

“If they were allowing the states to decide for themselves, they would have allowed California to decide for itself. California passed Proposition 8. So, what the Court was doing was it was invalidating California’s choice, and that’s exactly what the courts are supposed to do under the 14th Amendment. The 14th Amendment was passed for the specific reason of saying states have rights but one of those rights is not to discriminate against its own citizens.”

Boies goes on to say that this argument will be applied in fighting same-sex marriage bans in each state.

Atty General Kamala Harris: '50,000 Children in California...are Asking, Why Can't My Parents Be Married Too?' - VIDEO

California Attorney General Kamala Harris delivered a ferocious defense of equality when questioned this morning by CNN's Candy Crowley about why the state of California was not defending Proposition 8:

"I am absolutely against a ban on same-sex marriages because [bans] are simply unconstitutional...And the Constitution of the United States dictates, I believe, under every court precedent that we have discussed in terms of describing marriage as a fundamental right that the same-sex couples that are before the United states supreme court — Mrs. Windsor, Miss Perry — be allowed to have equal protection under the laws as any Americans when it comes to their ability to join themselves with their loving partners in marriage and raise their children...

...It gets back down to a very simple notion of fundamental rights, fundamental concepts of justice, fundamental concepts of liberty. We have 50,000 children in California right now who are asking, 'why can't my parents be married too?"
