UK Home Secretary: Iran Safe for Gays if They're 'Discreet'

Details of a letter sent from UK Home Secretary Jacqui Smith to Lord Roberts of Llandudno, a Liberal Democrat peer, published by The Independent, have angered gay activists.

Jacqui_smithThe letter followed Smith's rejection of a call for the immediate halt of deportation for gay and lesbian asylum seekers whose safety might be threatened by return to Iran, following the granting of asylum to gay Iranian teen Mehdi Kazemi.

Said Smith in the letter: "We recognise that the conditions for gay and lesbian people in Iran – and many other countries – are such that some individuals are able to demonstrate a need for international protection. We do not, however, accept that we should make the presumption that each and every asylum-seeker who presents themselves as being of a particular nationality or sexuality, regardless of their particular circumstances, should automatically be ... allowed to remain in the UK...With particular regard to Iran, current case law handed down by the Asylum and Immigration Tribunal concludes that the evidence does not show a real risk of discovery of, or adverse action against gay and lesbian people who are discreet about their sexual orientation."

Said Ben Summerskill, chief executive of gay rights group Stonewall: "You only have to listen to people who were terrorised by the Metropolitan Police in the 1950s and 1960s to know that telling gay people to live discreetly is quixotic."

UK Grants Asylum Request from Gay Iranian Teen Mehdi Kazemi

Gay Iranian teen Mehdi Kazemi, whose appeal for asylum in the UK made headlines in mid-March and inspired protest at Downing Street, has been granted permission to stay:

Mehdi_kazemi"Mr. Kazemi told UK Gay News today that he had received a letter from the Border and Immigration Agency of the Home Office to say his asylum request had now been granted. 'I am so happy,' he said, adding that he was grateful to all the help he ad been given, especially by Simon Hughes MP. There will be a full statement tomorrow."

Kazemi's case had been in limbo while the Home Office considered it. Hopefully, it will result in new policies for cases of gays and lesbians fleeing persecution in their countries.

London Supporters of Gay Iranian Teen Stage Downing St Protest

London supporters of gay Iranian teen Mehdi Kazemi staged the demonstration outside Prime Minister Gordon Brown's residence at 10 Downing Street I posted about on Friday. These photographs of the protestors were shot by UK blogger Cosmodaddy.

Kazemi, who awaits deportation from The Netherlands to the UK, was granted a temporary reprieve from deportation from Britain by the Home Secretary last week after public outcry. Kazemi's prior request for asylum in the UK was turned down in 2006 after British authorities determined that Iran is a country that does not systematically persecute gays. But that's because Iran does not recognize homosexuality.

Activists have been working hard demanding Britain change their asylum policies.

UK Gay News reports: " Over 120 protesters braved hail and rain on Saturday to demand that gay Iranian asylum seeker, Mehdi Kazemi, be granted refuge in the UK. They also urged asylum for the Iranian lesbian refugee, Pegah Emambakhsh, and an estimated 12 other gay Iranians who are at risk of deportation back to Tehran. There were calls for a “fundamental reform” of the way the Home Office treats LGBTI asylum applicants."

According to UK Gay News, Peter Tatchell, who spoke to the BBC last week about the issue, told the rally:

Mehdi6"The government is currently failing LGBTI refugees. Asylum staff and adjudicators receive race and gender awareness training but no training at all on sexual orientation issues. As a result, they often make stereotyped assumptions: that a feminine woman can’t be a lesbian or that a masculine man cannot be gay. They sometimes rule that someone who has been married must be faking their homosexuality. The government refuses to explicitly rule that homophobic and transphobic persecution are legitimate grounds for granting asylum. This signals to asylum staff and judges that claims by LGBTI people are not as worthy as those based on persecution because of a person's ethnicity, gender, politics or faith. The Home Office country reports on homophobic and transphobic persecution are often partial, inaccurate and misleading. They consistently downplay the severity of victimisation suffered by LGBTI people in violently homophobic countries like Iran, Nigeria, Iraq, Uganda, Palestine, Algeria and Jamaica. Cuts in the funding of legal aid for asylum claims means that most asylum applicants – gay and straight – are unable to prepare an adequate submission at their asylum hearing..."

Peter Tatchell on Iran and Gays: It's Like Nazi Germany

British activist Peter Tatchell talks to the BBC regarding the case of gay Iranian teen Mehdi Kazemi, who late last week (after much outcry) was granted a reprieve from deportation by the British government, which previously had rejected his asylum request.

Says Tatchell: "If it was true that there was no homosexuality in Iran, why does the Iranian penal code need to stipulate that sexuality is a crime, and that gay people should be sentenced to death? Obviously, that's absurd. And of course there is not a single openly gay person in Iran because if you declare you're gay you'll be arrested, taken to prison, tortured until you confess, and then executed in public. Every gay and lesbian person in Iran today lives with the fear of a knock on the door in the middle of the night. It's like Nazi Germany with regard to Jews. That's the fear that exists."

Following Reprieve, Gay Iranian Mehdi Kazemi Thanks Supporters

Following the British Home Secretary Jacqui Smith's announcement that they would be granting gay Iranian teen Mehdi Kazemi a temporary reprieve from deportation while they consider his case, Kazemi has thanked his supporters from around the world.

Mehdi_kazemiSaid Kazemi, through his uncle Saeed, who resides in the UK: "I am very thankful for everyone’s concern and help."

UK Gay News reports: "The announcement from the Home Office came as the European Parliament passed a resolution that said, in part that the EU Member states involved must 'find a common solution to ensure that Mehdi Kazemi is granted asylum or protection on the EU soil and not sent back to Iran, where he would be executed, hereby ensuring that article 3 of the ECHR is fully respected by all European authorities and notably, in this case, by the UK; asks the Commission and the Council to fully cooperate with the Member States on this case.' Peers in the House of Lords also petitioned the Home Secretary yesterday."

Kazemi is still in The Netherlands, and there is no word on when he would be sent to the UK.

There's now a website in support of Madhdi Kazemi (previous news reports have spelled his first name Mehdi), the Iranian teen who was just ordered sent back to the UK from The Netherlands and now faces possible deportation from Britain back to Iran even though he may be executed if he returns.

Kazemi's request for asylum in the UK was turned down in 2006 after British authorities determined that Iran is a country that does not systematically persecute gays. But that's because Iran does not recognize homosexuality.

Instead, they trump up false charges on gay teens and then execute them.

UPDATE: Kazemi receives temporary reprieve from UK deportation. "Gay Iranian teenager Mehdi Kazemi has been handed a temporary reprieve from deportation by Home Secretary Jacqui Smith. She announced his case will be reconsidered after concerns that he could face execution if removed to his homeland. Ms Smith said: 'Following representations made on behalf of Mehdi Kazemi, and in the light of new circumstances since the original decision was made, I have decided that Mr Kazemi's case should be reconsidered on his return to the UK from the Netherlands.'"

road.jpg Mehdi Kazemi, the gay Iranian teen I posted about earlier in the week who faced deportation from The Netherlands back to the UK where he faced another possible deportation back to Iran, where he'd likely be executed, lost his asylum appeal in the Netherlands: " Tuesday's decision by the Council of State -- the highest administrative court in the Netherlands --means Kazemi could face deportation to Britain, which he fears will send him back to Iran. Council spokeswoman Daniela Tempelman said the council decided it must comply with the Dublin Regulation and return Kazemi to Britain. Video Watch how teenager has lost his right to remain. Under the Dublin Regulation, European Union member nations agree that an application for asylum submitted in any EU country would be handled by that country alone. The regulation seeks to ensures that an asylum seeker is not redirected from nation to nation simply because none will take responsibility."

Gay Iranian Mehdi Kazemi Seeking Asylum in the UK

19-year-old Iranian Mehdi Kazemi is being held in detention in The Netherlands while a Dutch court deliberates whether or not it is legal for asylum to be sought in two European countries. Kazemi's request for asylum in the UK was turned down in 2006 after British authorities determined that Iran is a country that does not systematically persecute gays. But that's because Iran does not recognize homosexuality.

ABC reports: "While studying English and science in the U.K., Kazemi learned that his boyfriend had been executed for sodomy back in Iran. His father told him the boyfriend had confessed to Iranian authorities that Kazemi was his lover. The authorities, Kazemi found out, had already been to his parents' house with a warrant for his arrest. 'I was very scared,' Kazemi wrote in a letter accompanying his request for asylum in Britain and published in full on the website of the Canada-based Iranian Queer Organization. 'I wish to inform secretary of state that I did not come to the UK to claim asylum … But in the past few months my situation back home has changed. The Iranian authorities have found out that I am a homosexual and they are looking for me.' He continued, 'I can not stop my attraction to men … If I return to Iran I will be arrested and executed like [my boyfriend]. Since this incident … I have been so scared.'"

The Netherlands may decide to send Kazemi back to the UK, where his fate is again up in the air.

Pentagon Now Casts Doubt on Legitimacy of Iran Naval Provocation

The video on the left was released by the Pentagon, who claimed "Iranian speedboats swarmed around US warships in the Strait of Hormuz on Sunday and radioed a threat to blow them up." In response, Iranian TV broadcast the video on the right showing a clip of the incident from the Iranian point of view.

The New York Times reported today that the doubters of the legitimacy of the U.S. reports now include the Pentagon itself: "Unnamed Pentagon officials said on Wednesday that the threatening voice heard in the audio clip, which was released on Monday night with a disclaimer that it was recorded separately from the video images and merged with them later, is not directly traceable to the Iranian military. That undercuts one of the most menacing elements from the Pentagon’s assertion that Iranian forces threatened the Navy ships: The voice on the radio saying, 'I am coming to you. … You will explode after … minutes.'"

UK's Telegraph noted that the Iranian clip "shows no threat to US navy."
