Atty General Kamala Harris: '50,000 Children in California...are Asking, Why Can't My Parents Be Married Too?' - VIDEO

Harris

California Attorney General Kamala Harris delivered a ferocious defense of equality when questioned this morning by CNN's Candy Crowley about why the state of California was not defending Proposition 8:

"I am absolutely against a ban on same-sex marriages because [bans] are simply unconstitutional...And the Constitution of the United States dictates, I believe, under every court precedent that we have discussed in terms of describing marriage as a fundamental right that the same-sex couples that are before the United states supreme court — Mrs. Windsor, Miss Perry — be allowed to have equal protection under the laws as any Americans when it comes to their ability to join themselves with their loving partners in marriage and raise their children...

...It gets back down to a very simple notion of fundamental rights, fundamental concepts of justice, fundamental concepts of liberty. We have 50,000 children in California right now who are asking, 'why can't my parents be married too?"

California AG Harris Asks Appeals Court to Lift Stay, Permit Same-Sex Couples to Marry

California Attorney General Kamala Harris filed a motion with the 9th Circuit Court of Appeals today asking it to lift the stay on the federal court order directing California to allow gays to marry.

Wrote Harris in the brief: Harris

“For 846 days, Proposition 8 has denied equality under the law to gay and lesbian couples. Each and every one of those days, same-sex couples have been denied their right to convene loved ones and friends to celebrate marriages sanctioned and protected by California law. Each one of those days, loved ones have been lost, moments have been missed, and justice has been denied.”

Last week, attorneys Ted Olson and David Boies, who are representing the plaintiffs in the federal challenge to Proposition 8, announced that they had filed a motion asking the 9th Circuit Court of Appeals to allow same-sex marriages to resume in California, as well as a petition to the California Supreme Court asking them to further expedite proceedings in that case.

Harris

Says Harris:

"Also, maintaining a position that is the right position in saying we will not defend Proposition 8 because it is simply unconstitutional. ... One does not need to run from their convictions when they choose to run for office."
