Effective Immediately, All Gays Can Marry in Massachusetts

Massachusetts Governor Deval Patrick has signed the bill repealing a 1913 law barring out-of-state couples from marrying in Massachusetts if the marriages would not be recognized in their home state.
Effective immediately, same-sex couples from all 50 states can marry in Massachusetts!

Out-of-State Gays Will Be Able to Marry in Massachusetts Immediately
Due to a technical change made by the House, same-sex couples from out-of-state will not have to wait the standard 90 days before the repeal of the law takes effect. They will be able to be married immediately after Governor Deval Patrick signs the bill:
"The measure has moved to the Senate for its final approval. Aides say Gov. Deval Patrick may sign it into law as early as Thursday."

Massachusetts Votes to Allow Out-of-State Same-Sex Marriages
Same-sex couples from out-of--state should soon be able to marry in Massachusetts, as the House voted this afternoon 118-35 to repeal the 1913 law forbidding couples from marrying there if the marriage wouldn't be recognized in their home state.
The senate has already approved the repeal and Governor Deval Patrick has indicated he'll sign it.
The Boston Globe reports: "Unlike the Senate, which quickly voted to repeal the law on a unanimous voice vote, the House debated the bill for about 45 minutes. Supporters of the repeal called the law archaic and rooted in racism, urging fellow lawmakers to strip it from the books in the interest of equality. Repeal opponents argued for keeping the law in deference to other states, to prevent legal tangles involving couples who would marry in Massachusetts and want rights in states where gay marriage is outlawed...The 1913 law grew out of the national backlash over the interracial marriage of heavyweight boxing champion Jack Johnson, Rushing said today during the debate. At the time, 30 of 48 states banned interracial marriage, and many other states, including Massachusetts, enacted provisions that would keep interracial couples from crossing borders to marry in their jurisdiction. The law remained on the books but fell into obscurity until gay marriage became legalized in Massachusetts, and Governor Mitt Romney cited the law as a means to prevent Massachusetts from becoming what he called 'the Las Vegas of gay marriage.'"

Massachusetts House to Begin Debate on Repeal of 1913 Bill
The Massachusetts House is set to begin debate on the repeal of the 1913 law that forbids out-of-state couples from marrying there. The senate has already passed it, and Governor Deval Patrick has indicated he'll sign the bill.
The Boston Herald reports: "A person close to House leadership said debate would begin (today) on the repeal a 1913 law that prevents out-of-state gays from marrying in Massachusetts. The law says couples can’t marry if their unions would be illegal in their home states. The person demanded anonymity because the legislative calendar usually remains in flux until a session officially begins."

Jaws Jr. Comes Ashore

A shark that washed up on the beach of Nantucket off Cape Cod Monday may not seem like a big deal, but it's the first Great White to wash ashore there in 21 years.
"John Chisholm, a biologist with the DMF, traveled to Nantucket today to retrieve the shark and is transporting it back to the mainland where it will be dissected for further study and to determine a cause of death. 'It's not everyday we get a chance to study one up close,' Capone said. 'This confirms what we've been saying, that white sharks are not common, but not unheard of in the waters off Massachusetts.' The shark washed up on a beach off Sheep Pond Road Monday, and after it was discovered by several children on the beach, DPW workers along with an ATV police officer towed the shark off the sand and into a front-end loader parked on Sheep Pond Road."
Last week, a man on nearby Martha's Vineyard claimed "he had seen two sharks about 22 feet long and 3,000 pounds each while he was working on a fishing boat" near a public beach. That story turned out to be a hoax and the man has been charged with disorderly conduct.

UPDATE: The Senate has passed the bill. It now heads to the House, where it has the support of Speaker Salvatore F. DiMasi. Governor Deval Patrick has indicated he will sign it.

It was a little-used and rarely enforced law until opponents used it to prevent out-of-state gay couples from getting married in Massachusetts after the state legalized same-sex marriage in 2004."
WCVB reports: "State lawmakers are expected to vote this afternoon on repealing a law that restricts out-of-state gay couples from marrying in Massachusetts."
Predicted Arline Isaacson, of the Mass. Gay and Lesbian Political Caucus: "We are going to win this easily. It is not going to be a very difficult fight. People have gotten more and more used to same-sex marriage in the state. People who were once afraid of it or opposed to it find it either not something to fear or they just don't care because it has not affected their lives in a negative way at all."

Per DOMA, U.S. Census Bureau Won't Be Counting Gay Marriages
As of now, plans for the 2010 U.S. Census do not include recognizing the thousands of same-sex couples that are expected to be legally married in California and Massachusetts by that date:
"The U.S. Census Bureau, reacting to the federal Defense of Marriage Act and other mandates, plans to edit the 2010 census responses of same-sex couples who marry legally in California, Massachusetts or any other state. They will be reported as "unmarried partners," rather than married spouses, in census tabulations - a policy that will likely draw the ire of gay rights groups. The Census Bureau followed the same procedure for the 2000 census, and it does not plan to change in 2010 even though courts in Massachusetts and now California have ruled gay men and lesbians can marry lawfully... Critics say the census plan will mask the records of legal, same-sex, married couples and therefore degrade the quality of the government's demographic data. 'I just think it's bad form for the census to change a legal response to an incorrect response,' said Gary Gates of the Williams Institute, a think tank at the University of California-Los Angeles law school that studies gay-related public policy issues. 'That goes against everything the census stands for.'"
They have the data but they're just 'dutiful' followers: "'This has been a question we've been looking at for quite a long time,' said Martin O'Connell, chief of the Census Bureau's Fertility and Family Statistics Branch. 'It's not something the bureau could arbitrarily or casually decide to change on a whim, because our data is used by virtually every federal agency.' The Census Bureau is not falsifying people's responses, O'Connell said, because the bureau will retain people's original census responses. 'We're not destroying data; we are keeping that data,' O'Connell said. 'We are just showing the data published in a way that is consistent with the way every other agency publishes their data.'"

Efforts Underway to Repeal 1913 Massachusetts Marriage Law
Some state lawmakers and gay marriage advocates are hoping to repeal a 1913 law that in 2004 was used to prevent out-of-state gay and lesbian couples from traveling to Massachusetts to be legally married:
"The 1913 statute prevents Massachusetts from sanctioning marriages that are not legal in the state where the couple lives. The law was enacted in part to prevent interracial couples from evading their own state's ban by traveling to Massachusetts to marry. It was a little-used and rarely enforced law until opponents used it to prevent out-of-state gay couples from getting married in Massachusetts after the state legalized same-sex marriage in 2004."
Both the Senate and the House are expected to take up the issue as early as next week. With California as an example, many likely see the economic benefits as an impetus to repeal the law:
"Removing the law would put Massachusetts on par with California, where a court ruled in May that gay marriage was legal for all couples, including those who live out of state. In May, Governor David Paterson of New York directed all state agencies to recognize same-sex marriages in other states, including Massachusetts and California."
Said Governor Deval Patrick's spokesperson: "The governor supports the repeal of the law and will sign it if passed."

Cape Cod National Seashore Targets Sex in the Dunes

The Cape Cod National Seashore is teaming up with local officials this summer for a "public education" approach to a soaring number of citations for debauchery in Cape Cod's dunes:
"An example of the complaints was a call reporting Wednesday that a 65- to 70-year-old man was flashing people at Herring Cove Beach, according to Seashore records. In a Sept. 19, 2007, letter, a New Jersey family walking with children in the dunes encountered 'several couples and then a large group of men having group sex in the nude, including oral and anal sex right out in the open.' In an August 2007 letter, a whale-watch boat captain leaving Provincetown Harbor with passengers reported seeing 20 to 30 nude men 'playing around' near Wood End Lighthouse. Other complaints describe Seashore visitors encountering public sex acts at Head of the Meadow Beach in North Truro and near a Seashore building off North Pamet Road in Truro."
Said new Provincetown police chief Jeff Jaran: "It's not acceptable, decent, moral behavior. There is a time to be discreet, and there are places to go and do those types of things."

Daughter of Massachusetts Governor Deval Patrick: I'm Gay
Katherine Patrick, the 18-year-old daughter of Massachusetts governor Deval Patrick, has come out publicly in an interview with New England gay paper Bay Windows.
Said Katherine: "As private of an issue as it is, we’ve sort of had to come to terms with the fact that we are a public family and there you give a part of yourself away...And we also ... wanted people to know that it’s not only something that we accept, but it’s something that we’re very proud of. It’s a great aspect of our lives and there’s nothing about it that is shameful or that we would want to hide. ... And I’ll always remember the first thing my dad did was, [he] wrapped me in a bear hug and said, ’Well, we love you no matter what.’""
Bay Windows reports: "Patrick is the first elected official in the country to win statewide office after having campaigned on support for marriage equality. He spent a significant amount of political capital on the defeat of the marriage amendment, meeting privately with more than a dozen wavering legislators, strategizing with legislative leaders and publicly discussing why he supported marriage equality and why he thought the amendment should be defeated. But he says that the notion that one of his daughters could be gay didn’t factor into his advocacy on the issue. 'I don’t think we thought about who they loved - more that they knew what love was and that they would have love in their lives,' he explains. 'You know, it’s interesting even just thinking about having this interview. Katherine and Diane and I and her aunt and Sarah were all talking about, you know, would we give an interview to announce one of our kids was straight? It’s just not about the public ... it’s just about making sure that they had the fullness of their personality and their humanity...Fault me for not getting it,' the governor adds. Then he reveals when he got the first inkling that his daughter might be gay: 'I think when Katherine started to memorize all the episodes of The L Word, there was some hint that maybe she was sending us.'"

Ted Kennedy Undergoing Brain Surgery for Tumor
Senator Ted Kennedy, seen here last week on a sailboat near the Kennedy's Hyannisport compound, entered Duke University Medical Center to undergo a six-hour operation today for a malignant brain tumor, to be followed by weeks of chemo and radiation therapy:
The AP reports: "Experts said surgeons will likely try to remove as much of the tumor as possible while balancing the risk of harming healthy brain tissue that affects movement and speech. 'Almost no malignant gliomas are cured by surgery, but many of us believe that the more you get out, the next treatments, whether they be radiation or chemotherapy, have a better chance of working because there's less tumor there to fight,' said Dr. Matthew Ewend, neurosurgery chief at the University of North Carolina, Chapel Hill. The surgery was scheduled to begin around 9 a.m., said Anthony Coley, a Kennedy spokesman. The hospital had given no updates by late morning."
UPDATE: Kennedy treatment said to be successful.

Man charged in killing of Florida gay activist Scott Graham: "A man has been charged with murdering West Palm Beach, Fla., gay rights activist Scott Graham, who was found dead in his home on April 16, The Palm Beach Post reported Wednesday. Ricardo David Fuenes-Valle, 20, was arrested on Tuesday near Tampa by Hillsborough County deputies and U.S. marshals. He is being charged with first-degree murder. Investigators found the suspect on Tuesday after they were told that Fuenes-Valle was planning to rob Graham or burglarize his home to steal jewelry and money, West Palm Beach police captain Pat Maney told the Post. Witnesses said Graham was last seen on April 14 with Fuenes-Valle. 'We don't really have a motive at this point,' Maney said in the article. 'We are working under that assumption.'"

North Carolina adds new rule to Patents' bill of rights ensuring that same-sex partners will get visitation rights: "The rule adds a provision to the Patients’ Bill of Rights, stating: “A patient has the right to designate visitors who shall receive the same visitation privileges as the patient’s immediate family members, regardless of whether the visitors are legally related to the patient.” The right applies to hospitals statewide. 'We know how important it is that patients have their loved ones by their sides, but all too often same-sex partners have been turned away when their partner is hospitalized.' said Ian Palmquist, Executive Director of Equality NC Foundation. 'The new policy will ensure that the patient’s wishes are respected. This is a victory not just for same-sex couples, but for unmarried opposite-sex couples, caregivers, and other loved ones whom the state does not legally recognize.'" Medical decisions are not covered under the new rule.
