Gay Man Files $60 Suit Against Bible Publishers

Michigan man Bradley LaShawn Fowler has filed a $60 million suit against Zondervan publishing and a $10 million suit against Nashville-based Thomas Nelson Publishing saying versions of their Bibles which call homosexuality a sin violate his consitutional rights:

Fowler"'The Court has some very genuine concerns about the nature and efficacy of these claims,' the judge wrote. Fowler, 39, alleges Zondervan's Bibles referring to homosexuality as a sin have made him an outcast from his family and contributed to physical discomfort and periods of 'demoralization, chaos and bewilderment.' The intent of the publisher was to design a religious, sacred document to reflect an individual opinion or a group's conclusion to cause 'me or anyone who is a homosexual to endure verbal abuse, discrimination, episodes of hate, and physical violence ... including murder,' Fowler wrote. Fowler's suit claims Zondervan's text revisions from a 1980s version of the Bible included, and then deleted, a reference to homosexuality in 1 Corinthians without informing the public of the changes."

Clinton Wins Puerto Rico as DNC Votes on FL, MI Delegate Issues

Howarddean

The DNC Rules and Bylaws committee voted to resolve the Michigan and Florida delegate situation over the weekend.

RallySaid Howard Dean at the opening of the meeting: "This is not about Barack Obama, this is not about Hillary Clinton. "This is about our country. This is about restoring America to its greatness. There have been very tough disagreements and ugly moments. Emotions have run very high. There have been blatantly sexist comments, particularly by some members of the media. And blatantly racist remarks. And we know that those comments have no place in our society... We need to come together."

Talking Points Memo reports: "In a huge blow to Hillary's hopes, such as they are, the DNC Rules and Bylaws Committee has now voted in favor of a compromise measure for Michigan, giving 69 pledged delegates to Hillary Clinton and 59 to Barack Obama at a half-vote each. This effectively ends Hillary's bid to seat the Michigan and Florida delegations in full -- which she was hoping for in a last-ditch effort to close the delegate count and, more importantly for her campaign's moral arguments, to try to narrow Obama's unofficial popular vote lead. Still, Hillary's chief delegate counter, Harold Ickes, seemed to signal that there's still a possibility that she might fight on. In a harsh tone of voice, Ickes told the committee that Hillary personally informed him that she reserves the right to take the dispute over Michigan to the Credentials Committee in Denver, on the grounds that the committee had no right to transfer 'Uncommitted' votes over to Obama."

Ickes remarks at the DNC meeting, above right. Here's the Clinton campaign statement.

The decision upset many Clinton supporters, including this woman, who was thrown out of the rules committee meeting and whose ugly rant was widely published across the blogosphere this weekend:

AmericaBlog reports that protests over the DNC meeting have been overblown by the media.

Meanwhile, Clinton won an overwhelming victory in Puerto Rico over the weekend.

ClintonThe NYT: "Senator Hillary Rodham Clinton won another overwhelming victory over Senator Barack Obama on Sunday — this time in Puerto Rico — even as many Democrats, including some of her supporters, suggested it would be best if she dropped her threat to battle on past the end of the primary voting on Tuesday. 'There’s nobody taking Hillary’s side but Hillary people,' said Donald Fowler of South Carolina, a former national party chairman and one of Mrs. Clinton’s most prominent supporters, referring to her campaign’s suggestions that she might seek to challenge the way the party resolved the fight this weekend over seating the Michigan and Florida delegations. 'It’s too bad. She deserves better than this.' In a telephone interview Sunday from San Juan, P.R., Mrs. Clinton still raised the possibility that she would challenge the party’s decision on seating those delegates. 'Well, we are going to look at that and make a determination at some point,' she said. 'But I haven’t made any decision at this time.'"

Despite the Clinton victory, Barack Obama gained 17 delegates in the Puerto Rico vote, leaving him just 47 short of the 2,118 required for the nomination.

Court: Michigan Gay Marriage Ban Affects Health Benefits

The Michigan Supreme Court ruled 5-2 today that state employers, including government offices and schools, cannot offer health insurance to the partners of gay employees.

MichiganAccording to the Detroit Free Press, "An amendment to the state constitution approved by voters in 2004 to define marriage as the union of one man and one woman also prohibits public employers from providing health care and other benefits to the same sex partners of employees, a divided Michigan Supreme Court ruled today. The court majority found that language in the amendment prohibiting recognition of other unions 'for any purpose' included the extension of benefits to gay and lesbian partners of public employees. Several Michigan universities, including U-M and MSU, along with various municipal and school employers had offered the benefits as a means of attracting workers."

Michigan Killer of Gay Man Guilty of Voluntary Manslaughter

Scarborough

Steven Scarborough, a 22-year-old Tennessee man, who faced a felony murder charge that carries a life without parole sentence in the killing of 62-year-old Victor Manious in Grand Rapids, Michigan, got off easily yesterday when a jury found him guilty of voluntary manslaughter which carries a maximum 15 years in prison.

ManiousmurderScarborough's attorneys used a "gay panic" defense, suggesting that the murder was a reaction to Manious' sexual advances. Prosecutors had said that Scarborough lured Manious from a gay bar to his friend's apartment with intent to rob him, but ended up murdering him. Manious' body was found in the trunk of his car, and Scarborough spent the days following the murder shopping, traveling, and dining with Manious' credit cards.

The Grand Rapids Press reports: "Upon hearing the verdict, Scarborough hugged his lawyer, Paul Denenfeld, and smiled. His mother, Veronica Hand, in court with her husband, Michael, wept. Grand Rapids Police Detective Kristen Rogers, who interviewed Scarborough once he was apprehended, put her head in her hands. Kent County Assistant Prosecutor Helen Brinkman said she would tell the Manious family she did her best. 'I just wish the jury would have known about his previous record and that he came to Michigan to flee the conviction,' she said. Denenfeld said the jury was aware of his previous record and obviously believed that he was a victim of an assault."

Accused Killer Uses 'Gay Panic' Defense in Michigan Murder Trial

Maniousmurder_2

A jury in Grand Rapids, Michigan began its deliberations yesterday in the murder trial of 21-year-old Steve Scarborough, who last July struck 62-year-old Victor Manious with a bat before dragging Manious down a flight of stairs and putting him in the trunk of the victim's car where he was left to die. Scarborough, then, according to The Grand Rapids Press, "spent the next several days dining, shopping and traveling with credit cards belonging to Manious."

The prosecution claims that Scarborough was at a gay bar and targeted Manious for robbery, luring him to his friend Justin Robinson's apartment where the robbery was botched, Manious was struck, and the body was hidden. The defense claims that Manious, who came to the apartment looking for Robinson, knocked out Scarborough and when Scarborough awoke Manious was performing oral sex on him, which set off the chain of events leading to the murder. Another report has a slightly different version of event with the same gist.

Meanwhile, the Manious' widow and daughter can't comprehend that Manious was leading a secret gay life.

DNC Chair Dean Urges Florida and Michigan to Re-do Contests

DNC Chair Howard Dean is urging officials from Michigan and Florida to propose plans to re-do their state primary contests, the AP reports:

Dean"The two state parties will have to find the funds to pay for new contests without help from the national party, Dean said. 'We can't afford to do that. That's not our problem. We need our money to win the presidential race,' he said. Officials in Michigan and Florida are showing renewed interest in holding repeat presidential nominating contests so that their votes will count in the epic Democratic campaign. The Michigan governor, top officials in Hillary Rodham Clinton's campaign, and Florida's state party chair all are now saying they would consider holding a sort of do-over contest by June. That's a change from the previous insistence from officials in both states that the primaries they held in January should determine how their delegates are allocated. Clinton won both contests, but the results were meaningless because the elections violated national party rules."

The Detroit Free Press reports: "Michigan Gov. Jennifer Granholm, a Clinton supporter, said the victory in Ohio changes "the landscape a bit" and could open the door to a Democratic caucus -- not a primary -- in Michigan, though it would have to be privately funded and both candidates would have to agree. 'Michigan and Florida votes should count. To not count them at all would alienate these states in the general election,' she said."

Granholm_cristAnd according to the Tampa Bay Tribune, "Florida Sen. Bill Nelson, the state's senior elected Democrat, called Gov. Charlie Crist on Wednesday to discuss the possibility, according to a spokesman. The two agreed that Florida taxpayers shouldn't pay the tab, and Nelson thinks the Democratic National Committee should bear the cost, said Nelson spokesman Dan McLaughlin. A statewide vote would likely cost into the double-digit millions. Meanwhile, Crist, a Republican, issued a joint statement along with Democratic Michigan Gov. Jennifer Granholm calling it 'reprehensible" and "intolerable' that both national parties are penalizing Florida and Michigan over their primary dates. 'Seat our delegates,' Crist and Granholm demanded."

Romney Takes Michigan GOP Primary, Hillary Trounces Uncommitted

Apparently the campaign in America's Mitten worked, as Mitt Romney won the Michigan primary yesterday with 39% of the vote.

Above, if you're interested, is giddy Romney's victory speech.

On the Democratic side, the state was stripped of all of its delegates for violating party rules. Because Michigan scheduled their contest before February 5 (only Iowa, New Hampshire, Nevada and South Carolina are allowed to do so), the state was punished.

Hillary Clinton was the only candidate who did not pull her name from the ballot, which resulted in a decisive win against that other party juggernaut, Uncommitted.

Mike Huckabee: Amend Constitution to Reflect God's Standards

In one of Mike Huckabee's final stump speeches to Michigan voters, he really showed off his true colors:

"I have opponents in this race who do not want to change the Constitution. But I believe it’s a lot easier to change the Constitution than it would be to change the word of the living God. And that’s what we need to do is amend the Constitution so it’s in God’s standards rather than trying to change God’s standards so it lines up with some contemporary view of how we treat each other and how we treat the family."

You listening, Michael Stipe?

Huckabee ended up third in the Michigan primary, with 16% of the vote, behind McCain with 30%, and Mitt Romney, the most recent GOP winner, with 39%.

University of Michigan Offers Course on How to be Gay

A course taught by professor David Halperin at the University of Michigan has been getting some attention recently. "How to be Gay: Male Homosexuality and Initiation" examines "the general topic of the role that initiation plays in the formation of gay male identity" via writing, studying it as a "sub-cultural practice", and conducting some sort of self-reflective class experiment.

HalperinIt's actually a class that has been taught, and has inspired controversy and discussion, for a few years.

"In particular, we will examine a number of cultural artifacts and activities that seem to play a prominent role in learning how to be gay: Hollywood movies, grand opera, Broadway musicals, and other works of classical and popular music, as well as camp, diva-worship, drag, muscle culture, taste, style, and political activism. Are there a number of classically 'gay' works such that, despite changing tastes and generations, all gay men, of whatever class, race, or ethnicity, need to know them, in order to be gay? What is there about gay identity that explains the gay appropriation of these works? What do we learn about gay male identity by asking not who gay men are but what it is that gay men do or like? One aim of exploring these questions is to approach gay identity from the perspective of social practices and cultural identifications rather than from the perspective of gay sexuality itself. What can such an approach tell us about the sentimental, affective, or subjective dimensions of gay identity, including gay sexuality, that an exclusive focus on gay sexuality cannot? At the core of gay experience there is not only identification but disidentification. Almost as soon as I learn how to be gay, or perhaps even before, I also learn how not to be gay. I say to myself, 'Well, I may be gay, but at least I'm not like that!' Rather than attempting to promote one version of gay identity at the expense of others, this course will investigate the stakes in gay identifications and disidentifications, seeking ultimately to create the basis for a wider acceptance of the plurality of ways in which people determine how to be gay."

Then there's the alternative method: six beers, an off-campus party, and that hot freshman from down the hall you've been studying from afar.

It is also known as a safe place for diverse communities, including the most visible GLBT community in the state." Read Covey's press release here (PDF)

The Detroit News reports: "With the legal battle over whether Proposal Two requires the granting benefits to same sex couples being waged now in the Michigan Supreme Court, [Susan] Horowitz (founder of Pride Source and co-publisher of Between the Lines) said the Ferndale vote was especially encouraging. 'You just look at Ferndale as a really shining light in a state that's had some setbacks,' she said. 'I'm just ecstatic.' Covey, a Ferndale resident for 18 years, founded the Midwest AIDS Prevention Project. As a city councilman, he has championed the city's Human Rights ordinance, mass transit and green-friendly policies."

Leah Closson, a resident of Ferndale for 16 years, told the paper: "He represents the overall interests of everyone in the city. We're a heterosexual family with two kids and we own our own home. I feel he represents us."

Here's more on the benefits case currently being heard by Michigan's Supreme Court. The court is deciding whether Michigan's marriage amendment prohibits the state from extending health and other benefits to partners in same-sex relationships: "Lawyers representing public employers, affected employees, Gov. Jennifer Granholm, the ACLU and gay rights groups said voters' support for the amendment reflected a desire to protect the institution of marriage, but not to limit health care or other worker benefits."

road.jpg Madonna cuts $100 million+ deal with Live Nation. NYT: "The deal, which was first reported yesterday on The Wall Street Journal’s Web site, is the latest example of how tough times for record labels and concert promoters have set off a free-for-all over the rights to the various revenue streams created when a musician becomes a star. Instead of sharing in only one piece of the income — say, CD sales — companies are angling to share in all of an artist’s business lines, like publishing, merchandise sales and endorsement fees."

road.jpg Young Frankenstein's Broadway transition experiences pre-opening controversy: "The latest members of the Down-on-Mel Club are some members of the Dramatists Guild - furious at him for not paying his dues - and a small but vocal group of gay people who work backstage and bristle at what they believe are some insensitive jokes in the show."

'We were making enough noise to get noticed,' said Montgomery, who remembers living off his savings when the organization got started. Today, the Triangle Foundation is one of the state's leading gay rights and advocacy organizations with a $1 million budget and programming that ranges from victim services to camps for gay, lesbian and transgender youth."

Insurance Co: Gay-Friendly Church a "Higher Risk" Property

A branch of The United Church of Christ in Adrian, Michigan was recently solicited by an insurance company, asking if they wanted an insurance quote. The church replied "yes" but the insurance company, Brotherhood Mutual, then refused to give it to them after learning about their gay-friendly policies.

Adrianmichigan_2The UCC reports:

"Brotherhood Mutual Insurance Company, based in Fort Wayne, Ind., told West Adrian United Church of Christ in Adrian, Mich., that its denomination's gay-affirming stances made it a 'higher risk' for property and liability insurance. 'Our company's decision to not submit a quote to your organization arose out of information that was supplied in a supplemental application, indicating that your organization 'publicly endorses or practices the marriage of same-sex couples' and 'publicly endorses or practices the ordination of the homosexual clergy,'' wrote Marci J. Fretz, a regional underwriter for Brotherhood Mutual, in a July 30 letter to the church. Ironically, the church was fully insured by another company, and happily so, but was sought out by a local agent of Brotherhood Mutual who asked to provide the church a quote and then, subsequently, refused to do so."

You may remember, United Church of Christ produced the much-publicized "Ejector Seat" and "Bouncer" ads promoting their openness to accepting people of all races and sexual orientations to their denomination.

Here's a copy of Brotherhood Mutual's letter (PDF).

Weekend Protest Planned at Michigan Resort Hotel

Members of Detroit's Triangle Foundation will stage a protest from 11-3 on Saturday outside a resort hotel in East Tawas, Michigan, for its failure to assist a lesbian who was allegedly assaulted there at the beginning of September:

Easttawas"Investigators reported that a male guest, in his 60s, allegedly attacked Michigan resident Angela Potter during her Sept. 8 stay. The man reportedly used anti-lesbian slurs against Potter, police said Thursday. When Potter asked a hotel staff member to call police, the employee reportedly agreed to call but never did. An hour later, a bruised Potter phoned police herself, investigators said. Police responded, then turned the case over to local prosecutors for review. On Wednesday, prosecutors said they had issued no arrest warrant in the case. Both victim and suspect are out-of-town residents, police said. 'Both of them were bumped, bruised, scraped and cut,' said East Tawas Police Chief Dennis Frank, reviewing photographs this week. 'It appeared they got an equal share.' Neither victim nor suspect sought medical attention, Frank added."

Said Triangle Foundation Staff Member Melissa Pope: "There is no excuse - none - for the way the hotel treated Angie. We are calling on Tawas Bay Beach Resort to issue a public apology and at least a refund to her."

Leyton resident Naomi Robinson told the court she was shocked to hear Ms Grell call Mr Smith a paedophile during the election campaign. She said: 'Miss Grell told me to ask him [Mr Smith] about his 14-year-old boyfriend as she was driving away from the front of the house. I was quite shocked actually. I was not sure whether to believe it was true or not.'" UPDATE: Accused claims political conspiracy against her.
