San Diego Pride Attendee Arrested for 'Lewd' Gladiator Kilt Speaks Out About Lawsuit: VIDEO

Three years ago San Diego Pride attendee Will Walters was arrested on grounds of public nudity for wearing a costume that consisted of boots, a black leather gladiator kilt, black underwear, and a black leather harness with chrome rings; no formal charges were ever filed. After his arrest, Walters filed a lawsuit against the city of San Diego, alleging violations of the Fourteenth and Fourth Amendments, false arrest, battery, negligence and violation of his civil rights under California's Civil Code.

Walters also alleged discrimination and his lawyers provided photographs from other events such as the Over-The-Line tournament depicting patrons wearing less clothing that Walters had been, but who received no harassment from law enforcement.

Since then, a judge threw out the lawsuit under the ruling that "The Court finds that plaintiff proffers no competent evidence from which a reasonable fact finder could conclude that Walters' arrest was based on his sexual orientation, or that it resulted from an unequal enforcement policy or practice concerning public nudity," and that the arresting officer's actions were legal because "as Walters' [leather] loincloth moved … the wind blew, exposing his buttocks." Walters is now speaking out about the dismissal and will announce next week whether or not he plans to appeal the decision.

  3. People often think that all of California is like Los Angeles or San Francisco. Many parts of it are just as conservative as Utah or Oklahoma and San Diego is one of those parts. Remember that this is the state that PASSED Prop 8.

    i don't get it. having just witnessed a celebratory culture of drunken public vomiting and behaving like violent loons, yay st. pat's, i'm puzzled as to why folks get so out of whack over pride nudity. it's not as if pride celebrations are punctuated by violence and destruction of property. OMg! I saw an @ss!

  5. It's a question of equal treatment. A couple of years ago people sued the LAPD for the different treatment of people having sex in the park, straight people got a warning, gay people got arrested. IF he had been convicted, he would have to register as a sex offender for the rest of his life, this is worth fighting.

  7. An arrest is not like being charged with a crime. Cops and other public officials have a lot of discretion. False arrest charges are mostly to prevent too many citizen arrests and they are brought by the police! (They don't like the public making arrests). Judges aren't going to be sympathetic.

  8. I don't understand the hoopla. Why not follow the local law? How hard is that? If the law in San Diego requires you to cover your buttocks, why not cover your buttocks? Why not actually wear black underwear beneath your leather flaps instead of a black thong? Is it that important to you to have your ass hanging out?

  12. hmm.. if there's a place I'd expect nudity, it's at a pride celebration. I don't like the "family-friendly" excuse some people are using to nudge queer people who want to let it all hang out of the festivities. At the dyke marches I've been to, there are always bare breasted women and I've never seen them being hassled (and they shouldn't be). I'm glad this guy is fighting back for all of us.

  20. a few years ago in the pride parade in toronto, we (PFLAG) were marching behind either the leatherTNT dudes or some fetish group. either way, we had constant view of bums for a few hours. nobody freaked out. my dad laughed, my mum posed with them.

    so to all the complainers - congrats, you're less hip and liberated than many 60-something PFLAG parents.
