Trans Teen Charged With Battery After Defending Against Attacks


16-year-old California high school student Jewlyes had been enduring ongoing torment from bullies for being transgender until she finally fought back in self-defense. As a result, she is now being charged by the District Attorney for battery despite no one walking away from the altercation with anything more than light scratches. None of the other students involved, all three of whom ganged up on her, are having charges of any kind levied against them.

According to Jewlyes, she had made prior attempts to work with school officials to handle the bullying she was receiving, but to no avail. Deputy District Attorney Dan Cabral told NBC Bay Area that they will not comment on their reasoning for charging Jewlyes unless ordered by a court to do so.

  8. I do not condone bullying, and can certainly understand how prolonged torment could lead to an outburst. But it's also important to consider the facts of this case. Someone threw a piece of chewed gum at her, and she reacted by throwing punches.

    Understandable, but certainly not classifiable as "self-defense."

  9. If schools don't deal with bullying, you will probably need to initiate a lawsuit. They generally will be indifferent unless there is one.

  10. @Chip: If her tormentors and educators created an environment that included the ongoing fear of physical threat then, yes, any act of aggression could be justified as self defense.

    That is presented as a statement of fact.

    Shouldn't it actually read:

    "16-year-old California high school student Jewlyes CLAIMS to have been enduring ongoing torment from bullies for being transgender and CLAIMS that she finally fought back in self-defense."

  14. Mmmm, yeah. I think I'll wait to get all the facts before embracing this supposed victim. This is just one person's self-serving account of what happened.

    Trans activists have a long history of transforming trans criminals into heroes. Transgenders commit a lot of violence against women, and they try to excuse it by claiming that the women asked for it. So let's just wait and see what facts come out at trial.

  18. MARYM loves to rant against any hint of injustice against gay people but she is kinda soft when it comes to injustices against Trans people. She is not alone. There are quite a few gay haters of Trans people who regularly post on this site. Straight people don't have a monopoly on prejudice and hate.

  19. Derrick, it is true. And your using profanity doesn't make it not true nor does it persuade anyone of your position.

    It is really sad that as a man you feel the need to deny or belittle violence against women. But that violence is real and it is serious. Unfortunately, part of the problem comes from a group of angry men who think they are women and who vent their frustration on women. Google trans violence against women and read up.

    Obviously, some Transfolk can be monsters like any other people. My God, how many biologically born men and women have tortured and murdered their children? Too many.

  25. This is a local story for me and it seems this prosecutor has some agenda that he is not talking about. Everyone else seems perplexed why this is being handled by the criminal justice system and not as a disciplinary action by the school?

    I signed the petition to drop these charges because this action is outrageous.
