Off-Duty CO Police Officer Threw First Punch in Anti-Gay Bar Fight

This one's a doozie. Kell Hulsey, an off-duty Greeley, Colorado police officer and his son Daniel attacked a man (Brian Carter, pictured) on Sunday at the Pot Belly Deli Bar and Restaurant in Red Feather Lakes. They apparently thought the man, who has a lazy eye, was gay and checking Daniel out, the Greeley Tribune reports:

Carter_2"Dave Duty, 50, of Livermore is the owner of the Potbelly Deli and Bar, 24340 Larimer County Road 74E, where the altercation occurred. He said Greeley police Sgt. Kell Hulsey punched one of his regular patrons after Kell Hulsey's son, Daniel Hulsey, 28, of La Salle thought Brian Carter, 35, of Red Feather Lakes was gay and checking him out. Duty said he was behind the bar when the brawl broke out on the bar's deck between several locals and the Hulseys. Both Duty and bartender Sean McGlothlen, 21, of Greeley, who was working the night of the fight, said Kell Hulsey threw the first punch. 'The fact that he is going out and starting a bar fight is really disturbing,' McGlothlen said. 'It scares me that he is allowed to carry a badge.' The fight took place on a small wooden deck connected to the dimly lit bar lined with posters and filled with tables and two pool tables. The night of the fight, the bar, which connects to a karaoke room and restaurant, had about 100 people in it, Duty said. During the altercation, Daniel Hulsey, who was later arrested on suspicion of third-degree assault, took a pint glass and smashed it into Carter's head, Duty said. Carter, who was flown by helicopter to Medical Center of the Rockies in Loveland, where he received close to 20 stitches, declined to comment on the incident."

HulseyAccording to the Denver Channel, both elder and younger Hulseys cowardly fled from the scene: "Witnesses said, the attacker fled on foot, deputies said. Using a K-9 search dog, sheriff's deputies were able to track him down and arrested Daniel Stephen Hulsey, Campanella said. Hulsey, 28, was booked into the Larimer County Detention Center on third-degree assault charges, she said."

Here's another account of what happened, via the Coloradoan: "Out on the deck, Daniel Hulsey, the 27-year-old son of a Greeley police sergeant, was upset because one of the locals was looking at him funny. 'Brian has a lazy eye, and the younger Hulsey was accusing him of being gay,' Duty said. Brian Carter, one of the alleged victims of the fight who was hit over the head with a broken beer pint glass, was taken to Poudre Valley Hospital where he received fewer than 20 stitches, Carter said. Kell Hulsey, a member of the Greeley Police Department for 20 years, punched David Gniady, Carter's roommate, locals said. 'He yelled, 'I'm a cop and I'm a (expletive) ,' Gniady said. A fight involving up to 15 people ensued on the deck; and Duty, his staff and several locals ran to break it up. Kell Hulsey then threw several punches at another local before things settled down and he jumped off the deck yelling, 'You'll all die for this,' and leaving his son behind, witnesses said. 'For a cop, someone who should be breaking up a fight, to start a fight and flee when his son is here and going to be arrested, I mean...people that say he's a nice guy weren't here that night,' Duty said."

The officer, Kell Hulsey, is under investigation, and more arrests may be made, according to reports. The bar owner, David Duty, says he plans on filing a civil suit and seeking restitution. Red Feather Lakes is northwest of Fort Collins, Colorado, near the Wyoming border.

  3. Well, this violence coupled with the violence out of Queens NY tells us that no matter what our differences are(racial issues, the Obama candidacy, transfolk issues & ENDA, public park sex, what is male beauty?, Garland vs Streisand, etc)--we sure have one thing in common: plenty straight bastards want to kill us. I guess many "closeted" or "down low" homos want to kill us too--whether in a public park or public bar.

  6. And just how hotheaded do you have to be to start a fight because someone is looking at you? Were they drinking? Were they panicking that they've been found out (well, the son at least)? Hmmm....

  9. It is not anti-gay, it is just a guy looking for a reason to fight. I am sure he has seen the person there a million times and was looking for a beef to get things started.

Apparently by various reports on the Colorado newspaper websites there was upwards of 150 people fighting. Oh yeah it was the 4th of July weekend, people were probably drunk off their asses.

Now I am will say for the man that was severely injured there is no justification for the action what so ever.

Yes the cop will be investigated and hopefully justice will be served and damages paid.

  14. Makes me reconsider not acting on my recently upheld 2nd Amendment right.

  17. Charles,

I take back my comment 'cause being sarcastic & caustic may not be appropriate for this topic. I'm just surprised that you don't consider this an anti-gay incident.

Charles, when a straight guy(or closet case)says to a guy he perceives as gay, "whathcu' lookin' at faggot?"--that is anti-gay. It's frickin' pre-gay panic crap, "I'm going to beat you up because you're going to give me gay panic if I don't."

Some gay men rarely experience gay-bashing (verbal/physical) and y'all are out of touch with the characteristics of such attacks. It doesn't affect y'all and so y'all don't understand. I'm not meaning that in a derogatory way, but it appears to the case. Y'all just don't believe it's a problem for "normal-acting gay men"--it only affects sissies.

Well, if he got bashed in a public park, then would y'all believe it was anti-gay....but then, he'd probably deserve it then, hunh?

Oh, Lord, why was I born?...what do I get? what am I giving....

  18. Daniel Hulsey is obviously an angst ridden hairdresser whose dreams of being a broadway star have gone unfulfilled. He really needs to find a healthier avenue to vent; may interior design.

  22. I always get a rise (laugh) out of all the straight guys bitching about gays (supposedly) looking at or anywhere near them.

These same troglodytes on the other hand can harass women as though it is their god given right. and the harassment isn't limited to adult women.

I live next to a Catholic school. Daily I see men of all ages ogling the girls playing in the school yard as they drive bye or as the girls walk to or from school.

I'm talking about early teen girls here, and god forbid some younger! These aren't grazed perverts (at least overtly). They are guys letting off there own daughter(s) and other dudes driving bye in suites on the way to work.

They are the same homophobes ready to pounce on any gay or perceived gay man whose gaze comes anywhere near their direction, intentionally or not.

  23. "plenty straight bastards want to kill us."

Who says they're straight? Their own claims don't count.

I've said it before and I'll say it again and again: I've never known of any wholly straight guy who was so upsets by fags that he decided to physically attack or harass one. 99.9% of the time gay bashers are closeted and sexually insecure.

"sigh. why, oh why, do fag bashers always have to be so goddamn good looking?"

Because the pretty ones are always the most insecure about their sexuality and everything else? I'd also hazard a guess that they're that much more likely to have taken someone up on their "unwanted" sexual advances.

  25. CHAS,

you're absolutely right. But, you know, some guys call themselves "straight" but, no, they are not totally heterosexual. And some of them are ok with gays, and some of them are sick motha' fu...s who want to kill gays. (sometimes I spell out vulgarities and sometimes I don't...it depends on whether it's that time of the month. Andy is tolerant)

  26. I think they deserve trial subscriptions to Advocate/ Out/ Genre sent to those addresses Payback found!!

    Posted by: jjh | Jul 9, 2008 2:34:24 PM

  27. DERRICK: I've had so many awkward-and-random-yet-cute experiences with guys who claim they're straight. I know they're not all monsters who want to harm or murder gays. Some of them are wonderful people who are just trying to figure themselves out. It just so happens that nearly all--if not all--homophobic attackers see in their victims what they hate and fear about themselves.

JJH: The Advocate would be constructive if they actually took the time to read it (assuming they can read). But trial subscriptions to Genre and Out would be a punishment better suited for me or Micheal Bedwell.

  29. "It is not anti-gay, it is just a guy looking for a reason to fight. I am sure he has seen the person there a million times and was looking for a beef to get things started."

Right, Charles. Punching a guy because you think he's looking at another male "funny" and then "accusing him of being gay" isn't anti-gay at all. I'm sure all the LGBT people who are victims of violence just happened to stray into the path of some innocent "guy looking for a reason to fight." Anti-gay harassment and violence is all a myth!

  30. Try again, ANON.

    Posted by: Chas | Jul 9, 2008 4:05:15 PM

  31. I agree with ANON, in the sense that, the opportunity for bashing, is more likely presented to the more attractive prospect bashers.

I'll be the fist one to admit, that it is rather irritating when someone hits on you and doesn't know when to stop. But when did a "not interested" stopped being sufficient? I mean from that to physical aggression there is quite a stretch. The sad part, is that sometimes not even hitting on someone is necessary to be gay bashed, and this is the reason I know carry a gun in my car.

  34. It is widely reported in Colorado papers that Carter (the one with the lazy eye who was attacked for no reason) is NOT GAY. That's the clincher, the Hulsey girls are so paranoid they beat up a guy who was probably NOT looking at them, and not for the reason they dreamed of.

When are we going to hear of a hot lesbian bashing the shit out of some idiot because he looked at her like a rapist? C'mon womyn, we know you're out there, defend yourselves!

  35. Ultimately, battery is battery...the feeble excuse that instigated it is sort of irrelevant. One of the "universal expectations" at the elementary school where I work is to respect others and to keep your hands and feet to yourself. If father & son had learned that lesson long ago, this would all be a moot point. Questioning sexuality and motive are likely futile. These two clearly don't understand what it means to be civilized; how can we possibly expect them to understand constructs as complex as their own sexuality and motivations?
