Proposition 8: California Supreme Court to Rule Tuesday

The California Supreme Court has posted notice of an opinion filing on Proposition 8 for Tuesday, May 26 (PDF).

Supremecourtca The Court will announce its ruling in three cases challenging Proposition 8: STRAUSS et al. v. HORTON; TYLER et al. v. STATE OF CALIFORNIA; and CITY AND COUNTY OF SAN FRANCISCO et al. v. HORTON.

  1. Any rally in NYC is stupid. For something all the way out in California?! N.Y. Sen. Ruben Diaz held an anti-gay-marriage rally in Manhattan last Sunday, with thousands of his supporters, and how many counter-protestors were there? About two? It makes gays look like they're only brave enough to protest when they're not face to face with the adversary.

  2. The court is probably going to rule to uphold PROP 8. For the first time, equal rights will have been granted to us and then taken away. PLEASE get out and protest on Tuesday night. It is not just about marriage in California. This is about fair and equal treatment under the law for all US citizens.
    The protests on Tuesday should be about demanding full equality from the federal government. Nothing less.

  3. I'm nervous.

    I start my first day at my internship on Tuesday so I'm disappointed that I won't be able to be down there at Courthouse for the decision. Since I am working in GLBT rights, I hope the whole office goes down there.

    If it doesn't go away, I don't think peaceful protests are gonna do us any good. We need to be more radical.

    Why should we behave? Why should we, unlike any other citizens, have to be perfect to have our rights recognized? And why are we so willing to play the majority's game? Do we really think they are just gonna bend when we do behave?

    NO! They won't! We must take, by force, what is rightfully ours!

    To quote the Declaration of Independence: "We hold these truths to be self-evident, that all men are created equal, that they are endowed by their Creator with certain unalienable Rights, that among these are Life, Liberty and the pursuit of Happiness."

    We should do what our Forefathers did and FIGHT!

  5. I agree, JT. New Yorkers need to help themselves before they start getting involved in some court ruling that has nothing to do with them. Who has time to care about the bigots in California when there's plenty of work to be done in Albany.

    You guys don't get it. This IS about marriage rights in NY. It is about marriage rights everywhere. If the CA Supreme court decides that voters have the right to strip a suspect class (which they decided we were last year)of basic civil rights, then we are all in trouble. The Federal government is the best remedy at that point, and if we can impress upon Washington how many of us are not going to take this anymore, we can win Federal protections and that will end this ridiculous piece-meal state-by-state BS.
    If you make excuses for not protesting Tuesday night than you are part of the problem, not part of the solution. This is for New York and for everyone.

    I think that there issue is that it seems pretty ridiculous for NYers to be up in arms about something happening in CA, when NYers don't care about what's going on in their own backyard (RE Diaz's demonstration).

  11. ...and that's why shutting down one or two cities isn't enough. This country needs to be shut down. We need to take a page from Thailand's yellow shirt activists and from orgs like SNCC and SDS from the 60s. If you aren't willing to get your nose bloodied and put your life on the line then shut your pie holes because you won't get anything unless you demand it!

    It's important to get a list of expectations and demands ready too. It can't just be about marriage, ENDA or DADT. It's full equality under the law with no compromises and EVERYBODY that is in the bars and bedrooms needs to also be in the street or nothing will change!

I completely agree with BRUNO that it is pointless to fuck up traffic in San Francisco and Los Angeles while the folks who voted against us are left to drive freely through San Bernadino, Fresno and Bakersfield. We need to show these bigots that we will NOT stand for being treated differently under the law than everyone else.

  14. I think if Prop 8 stays that there are going to be riots. If i was there i would do that same thing and break shit, show them that they cant just put us in a corner and forget about us. Blacks had to riot and so did woman, now its our turn and we will get what we everyone else has.

  15. How about shutting down airports by blocking the main roads leading to them. In SF, that'd be 101. How about we all just park our cars and/or asses on the highway. Shutting down an airport creates a ripple effect all around the country/world.

You guys will get so much done from your jail cells... keep up the talk about "breaking things" or shutting down airports (say hello to Gitmo idiot, that's a major felony!)... that type of violence will only bring the other side down harder. You people in California screwed this up already, don't go out and create violence now causing all of us to be lumped into the same stereotype. You want to ACT UP, fine, but don't destroy. What would Harvey do? He certainly would not encourage people to destroy the Valley and shut down the airports.

  18. This is all very weird. Why did the California State Supreme Court grant marriage equality to begin with (in a very forceful ruling -- look it up) only then to rule taking it away?

    To hear from literally every news source they're going to "split the baby" -- let Prop 8 stand but allow the marriages that took place before it to remain legal.

    That's "what people say."

    What the court actually does we'll find out on Tuesday.

  23. Prop 8 will be overturned because though majorities rule in democracies, majorities cannot tyrannize minorities, deny them rights, criminalize their very existence on subjective grounds or religious grounds, or on any grounds whatsoever, nor turn them into second class citizens.

  25. So when those planes crashed into the twin towers on 9/11 that was just a NY thing? Prop 8 affects every person in this country. If NYers Bostonians, NOLA's, Miamians, etc. want to protest or celebrate they have every right to. This is the UNITED States of America.
