  4. RE latest issue of OutServe's magazine. The following is, necessarily, quite long. But those who actually care about what the reality behind their claims about ending the ban is will read it.

    The shorthand is that a group/publication promoting themselves as "experts" are empirically wrong. First, they repeat the popular myth that the DoD cannot allow the partner of a gay or lesbian service member to live in "military housing" because it is banned by DOMA, not just once but twice in one issue.

    If knowledge is power, then ignorance is powerlessness. So, here it is again, folks, very straight from the mouths of the November Pentagon Working Group Report's authors, on Page 15, [along with their hollow excuses for not using their legally empowered discretion] emphasis mine:

    “A third category of benefits are THOSE THAT ARE NOT STATUTORILY PROHIBITED, but that current regulations do not extend to same-sex partners. WITH REGARD TO THIS CATEGORY, THE DEPARTMENT OF DEFENSE AND THE SERVICES HAVE THE REGULATORY FLEXIBILITY TO REVISE AND REDEFINE THE ELIGIBLE BENEFICIARIES TO INCLUDE SAME-SEX PARTNERS. ....

    MILITARY FAMILY HOUSING IS ANOTHER PROMINENT BENEFIT IN THIS CATEGORY. However, we do not recommend at this time that military family housing be included in the benefits eligible for this member-designated approach. Permitting a Service member to qualify for military family housing, simply by designating whomever he or she chooses as a ‘dependent’, is problematic. Military family housing is a limited resource and complicated to administer, and a system of member designation would create occasions for abuse and unfairness.”

    Further, OutServe's T.J.'s editorial that gay and lesbian service members don't need to be included under the protections and affirmative actions of the Military Equal Opportunity Program is, at best, jejune. Despite the disingenuous claims by the DoD—transparently driven by the shameless rhetoric of the SEVEN antigay groups the authors met with, common sense tells us that if an historically discriminated against minority such as African-Americans who have been legally integrated into the services for over sixty years still need the MEO why wouldn't gays and lesbian, just now being openly accepted, also need it.

    But we need not just depend on common sense. Expert research by the Palm Center in 2004 has already documented that the similar approach that has been in place for about a dozen years in relation to the existing policy against harassment of those in the military perceived to be gay proves that "chain of command" alone is not only not a solution, it is often a source of the problem.

    “The military has created a two-class system with gay and lesbian service members in the second class. For example, the Pentagon's ban on racial harassment includes a broader mandate against race discrimination. And, the ban on race discrimination is reinforced by several provisions, which include the Department of Defense (DoD) Human Goals Charter 1 and the DoD Equal Opportunity Directive. ‘These provisions do not treat racial harassment and race discrimination separately; rather, racial harassment is considered a form of prohibited race discrimination’, wrote [the study’s author]. The military's ban on harassment of gay and lesbian officers, however, is not ‘codified’….”

    SLDN added, “There is no available avenue for service members who would typically report discrimination [based on sexual orientation] through an equal opportunity office. … In reality when a service member does report it through the chain of command it is rarely taken seriously. There's no consequence for commanders who ignore anti-gay harassment. The environment has created second-class citizenship for gay and lesbian service members and it permeates all military."

    Finally, despite T.J.'s tales of members of OutServe working with the DoD on tracking, the official policy is that there will be NO tracking of numbers or patterns of any kind of discrimination including harassment. Without measurement of how MUCH of a problem there is, WHY should we imagine them to take seriously FIXING it?

    The only explanation for comments like his is either gross ignorance of the history of the DoD's mistreatment of gays in so many ways that they must be presumed guilty until they prove themselves innocent and/or a kind of gay version of Stockholm Syndrome. Whatever the cause, OutServe owes its constituency much better than this.
