Jurors Say Brandon McInerney Deserves Leniency Because Larry King was the Bully

More jurors from the Brandon McInerney trial are speaking out with one saying McInerney got "a raw deal".

Kingmcinerney The L.A. Times adds:

One juror, identified only as Lisa S. because she did not want her whole name used, said many jurors came to believe that King was bullying McInerney by making unwanted sexual advances.

"This wasn't about him being gay,'' she said. "This was about bullying. There was a ton of evidence that Larry was acting inappropriately with other kids at school, and they didn't do anything to stop him."

As for the new case, she added: "It was overcharged and an abuse of power, and I don't think a new jury will see it any different."

I'd say getting shot in the head point-blank and killed by your classmate is a "raw deal" but that's just mho.

After all, I have a right not to be exposed to her unwanted and thinly-veiled bigotry, so that should give me the free and clear to put a bullet through her skull, according to her warped reasoning.

  7. WTF is wrong with these people? Larry a "bully"?!! "Unwanted sexual advances"?!

    The boy was shot at point-blank range at back of his head, not once, but twice! What "mitigating circumstances" could there possibly be?

    Larry was using whatever limited tools where at his disposal to deflect the hatred and homophobia he felt from others. He was not attacking Brandon.

    There was clear bias by these clueless jury members against Larry. Let's hope the prosecution does its job next time.

    What kind of screwed up logic is this? Even if Larry was making unwanted sexual advances, obviously thats inappropriate, but it doesn't merit a bullet to the brain. There is no jusitification whatsover, disgusting reasoning.

    Larry was obviously just young and reckless and didn't realize he was playing with fire. But Brandon is still a murderer no matter how you paint that picture.

  10. The very day that the first bullied gay kid shoots and kills his bully we will see just how valid this argument is. He will be roundly condemned by EVERYONE, will be tried as an adult and after one hour of deliberation will be found GUILTY on all charges and sentenced to death.

    This has got homophobia written all over it.

  11. Now I understand why they dropped the hate crime charge. The jurors are so homophobic in that area that they reverse it and see the killer as the victim. The killer first bullied Larry and then Larry fought back the best way he knew how. But the poor killer couldn't handle so he shot him. Poor killer. Jurors vote their prejudices whether it is convicting an innocent black teen on flimsy evidence or feeling sorry for a white teen who shot a gay kid in the head.

  12. The pattern is that when a LGBT person is a victim of Hate, they always appear to go on trial along with the assailant. There is always a veil sense created that we always bring it on by our behavior. A premise that appears to be lodged in the Heterosexual's Mind set. When we reported our stalker, the Policeman kept insisting that "you must be doing something to provoke him". My answer was "we are breathing".

  13. I think this juror is an idiot. There is no reason on earth that can justify one human being killing another...except maybe pedophiles. I would kill someone who harmed my child...and be happy to go to jail for it.

    You don't get to kill someone because they tease you. You don't even get to kill someone if they shove you. She's ridiculous. Just ridiculous.

    After reading the transcripts, I have a weird feeling about the case. It was too "personal" what went on with Lawrence and Brandon. I have this weird, weird feeling that maybe Brandon is gay and MAYBE something happened....I don't know tho. I don't know of ANY gay kids who would target a single bully like Lawrence did according to the transcripts and approach him in this way UNLESS he was making a point to him. It just seems completely out of character.

    It could very well be that Brandon didn't want anyone finding something out about himself and killed Lawrence to keep it quiet.

    There is a whole lotta wrong about this case. Like why the school pushed Lawrence in a particular direction or why they never got involved....something's fishy.

  14. This is why words matter. The right-wing, mostly xtian reasoning that we hear so frequently these days has permeated even our court system. It goes like this: "I attacked you because of my beliefs that you are wrong and a lesser human being and deserving of abuse. You didn't just take it quietly, but responded to it by defending yourself. So that makes ME the victim and I am now justified in doing whatever I want to you -- including shooting you in the back of the head." This logic now permeates our society, put forward by a whole host of right-wingers and supposed christians. And jurors are drawn from the members of society. Sickening.

  15. @Rin, I do agree with your assessment. While there was substantial evidence presented in the case that Brandon was exposed to violence and abuse at home, I suspect something "personal" here as well.

    Larry was clearly a threat to Brandon. Perhaps Larry was perceived as a threat to his masculinity, his social "status" in the school, whatever. Brandon believed he needed to kill Larry in a very public manner to "prove" his superiority.

    There is no evidence to support leniency in this case. Brandon is a murderer, he murdered a defenseless boy in cold blood at point-blank range. Homophobia and "gay panic" clearly influenced these clueless jurors.

    Larry should spend the next four decades in a CA prison. Perhaps that will give him enough time to understand the pain he has caused to a family, the life he destroyed, and the horror he unleashed on his community.

    Heck of a job his lawyer did for him in getting the jury to sympathize with his client instead of the victim, or is it possible these jurors came into the trial already predisposed.

  21. This comes as no surprise. First of all, Ventura county is long known as a country traditionally made up of majority conservatives. That's a reality that makes it pretty simple to see why a majority of judges would buy the gay panic defense. It speaks to the demographics of the country itself and what conservatives in general overall believe when it comes to this subject. The dissenting judges clearly DO believe that "unwanted homosexually-oriented sexual advances" warrants a bullet to the head.

    Jerry and Kit have it exactly right. People such as these judges, right-wing fundies, and really all homophobes, believe that they are victims. They believe our homosexuality is the issue, not the negativity surrounding it, not the abuse we take because of it. It is always our fault, because we're gay. We're always the ones to blame. If we weren't gay then these things wouldn't happen to us.

    This is the way these people think and this is what we're up against. This is what real resentment looks like. People who justify any sort of grievance against LGBT citizens without ANY sort of shame.

    I have yet to hear of one juror who wanted to convict him
    The prosecutors seem to have a strong case here
    How is it that they have so many jurors who want this kid to walk?
    Is his public lawyer that good?

This is an injustice disgusting beyond words, and it's time to highlight exactly what homophobes stand for as a group, and the facts of why Larry King is dead today. We can not allow Larry's death be in vain. His death and excuses made for it are a prime example of what LGBT students are facing daily in school.

    Unfortunately, in the eyes of many, who have a gay vs. straight mentality, there is no ability of reasoning with them.

  25. Based on what I've read, Lawrence King had been bullied by Brandon and his pals for a long time and eventually he fought back by responding to their taunts with "flirting." Instead of running away and crying he turned the tables on them the only way he knew how.

    He broke the unwritten rule that victims are just supposed to take it and he fought back by taunting them about their own sexuality by "coming on to" them in a satiric manner. Does anyone REALLY think he was trying to seduce his bullies? No, he was just using the only weapon he had.

    And Brandon McInerney killed him for it.

    And now, because he used flirtation and suggestive language they're going to paint HIM as the sexually aggressive bully chasing those poor, innocent little angels around?! In essence he's being bullied again in the courtroom, portrayed as the sick little queer once again, and frigging idiots like Lisa S are gonna buy it because it fits into their homophobic worldview. It's disgusting.
