  2. Sorry, but I believe Mr. Baume misstates one important aspect of DOMA -- he says that DOMA prohibits states from recognizing same-sex marriages performed elsewhere. That is incorrect.

    DOMA purports to ALLOW states to refuse to recognize same-sex marriages performed in other states, but it does not PROHIBIT them from doing so. (Of course, one of the arguments against DOMA is that this aspect of the DOMA violates the "full faith and credit" provision of the Constitution, that requires all states to recognize the acts of other states.) In fact, some states do recognize same-sex marriages performed in other states.

  5. As far as I can gather, Ireland will recognize marriages performed in New York as civil partnerships and not actual marriage - something Ireland doesn't actually have. I had presumed that gay marriages performed in New York are automatically recognised as marriages in countries that have gay marriage and as civil partnerships in countries which allow those.

  7. @PAUL : I think you are right Paul; marriages in New York would have to be recognised as Civil Partnerships in Ireland.. you correctly say , we don't have Same Sex Marriages in Ireland due to the terms of our Constitution......and it would be difficult ( for the time being) to get that provision overturned,.....hence then Civil Union compromise.

  8. @UFFDA -- sure. I wasn't criticizing Mr. Baume's overall presentation, which was fine. Just think that in fighting DOMA (as with fighting any unjust law) it's important for us all to be clear about exactly what it says. Knowledge is power.
