Liberty Council To File Lawsuit Against New Jersey's New Ban On Conversion Therapy

Earlier today, New Jersey governor Chris Christie signed the state's ban on gay-to-straight conversion therapy for minors. In his statement, Christie recognized that the ban was "government limiting parental choice on the care and treatment of their own children." Apparently, the right-wing Liberty Council believes this to be true as well, and announced their plan to file suit and have the ban overturned by the courts. 

The group announced their plan via a press release, which was released almost immediately after Christie signed the bill (entitled "A3371"). In it, the group's Founder and Chairman, Mat Staver, warned that:

"This bill is so broad that parents would be prohibited from seeking help for their son who developed unwanted same-sex attractions after being molested by the likes of Jerry Sandusky. Counselors would only be allowed to affirm these unwanted feelings as good and normal. This is absurd and dangerous. This law would inflict serious damage to children, parents, and counselors." 

Mat StaverOf course, the false correlation of homosexuality with pedophilia is a familiar and frequently-used tactic by opponents of LGBT rights. HuffPost Gay Voices also notes that the Liberty Council has "recently claimed gay people are controlled by lust and compared gay adoption to owning pets." The group also conveniently forgets to mention the fact that "the American Psychological Association has found that efforts to change sexual orientations can pose critical health risks," a fact that Governor Christie was sure to mention in today's statement. 

The Liberty Institute has said that they plan on filing their lawsuit immediately after the law takes effect. Since it is not yet clear exactly when that will be, New Jersey residents will simply have to wait and see how the controversy pans out. It's almost certain, however, that more statements will be released in the coming hours and days, both supporting and condemning A3371.

  2. I would say "they have no shot" but after what happened in California, can't do that. California passed a similar ban, and it was blocked within a couple months. Let's hope for a different outcome here.

  6. at what point does a child have rights separate from and protected from their parents?

    the xtianistas might regret bringing this case if going all the way to SCOTUS it is handed down that a right must not infringe upon the rights of another and that their children have a right to be protected from their parents religious beliefs

I don't intend for this to come across as obsessive or obnoxious, but I would like to gently point out that there is a difference between a council of individuals and legal counsel, or professional advice. They are spelled differently and mean two different things. Of course, the headline may have just been an unintentional typo, and if so I apologize for drawing attention to it.

  10. Good comments. Whenever I see an organization that touts the name Liberty (excluding the ACLU), my immediate reaction is that this is an organization that is against liberty. Sure enough, this organization wants to impose quack therapy on minors. So much for the rights of gay minors to be free from coercion and abusive "therapy."

This will probably hurt you in the Republican Primaries, should you choose to run for president, but it shows thoughtful Americans that you are an honorable man.

    WTF is a crown doing on the top of that damn thing? Doesn't seem very democratic, more like they're into monarchies.

    And really love the bible with the sword, spreads a nice subtle message of "Convert or die".

    They throw them away TO BE ADOPTED. Some times, if they don't like them, they just throw the Garbage out on to the street.

    and if you're straight, you can leave your Unwanted Garbage at some Fire Stations or Hospitals. Just dump them on the door step, ring the bell and run.

Ironic that to many on the right abortion is NOT a decision best left up to the parent(s) and requires government intervention yet they believe that the government has no business usurping parental responsibility and getting involved in gay conversion therapy. Another case of so-called social conservatives caring more about children before they are born than after.

    Gov. Christie has basically handed the Liberty Counsel their legal victory by stating in his signing of the bill into law that "government [is] limiting parental choice on the care and treatment of their own children". By saying as such, Christie has almost guaranteed this bill will be nullified in the courts.

  19. They will need a litigant that suffered a tort, so where in NJ is there a psychologists that practices gay conversion therapy? I know there are rabbis in the state that preach about the virtues of conversion and offer counseling, but I'm not sure counseling is banned by the bill. If it were, it's likely to get struck down by the courts as a 1st amendment violation.

This may seem a harsh indictment, but, in my opinion, The Liberty Institute (Counsel) is little more than a brainwashing, re-education gulag, aimed at terrorizing juveniles of nascent sexuality, gender and orientation, which, with the complicity of the parent(s) of these susceptible juveniles, seeks to continue to instill some mutant form of Stockholm Syndrome in these institutionally abused kids. Horrendous! With their lawsuit, I hope that they spend themselves into oblivion and down to their last penny on court costs and legal expenses. These people are a shameful scourge on society and its most innocent and vulnerable in need of nurturing, support and protection: children!
