  1. Wait, wasn't NOM decrying the fact that the "will of the people" had been subverted by the NJ Supreme Court? Yeah, that's what I thought.

  2. NOM's strategy now is a money-making, survival strategy: Gay marriage should only be decided by voter referendums at the state level, not by legislatures or courts. They've retreated to this strategy because they've lost in the legislatures and the courts. And while they've also lost in the most recent referendums--Maryland, Maine, Washington state and Minnesota--they know they would win if the the issue were brought before voters in states like Kentucky and Utah.
The let-the-voters-decide strategy would ensure that NOM and the gay marriage issue remains alive for years to come as a large block of red states, especially in the South, would vote against marriage equality.
Keeping the issue alive via a split between the states would ensure that Brian gets his $250,000 plus incentives income for some time.
So, NOM wants to see this fallback "let the people decide" strategy prevail. It probably won't. The next supreme court case will focus on the 14th amendment, and set the issue to rest.
