Woman Found Guilty In Attack On Gay Couple Walking Pink Poodle

Towleroad previously reported on the case of Portland-area gay couple David Beltier and Jeremy Mark, who were attacked while taking their pink poodle, Beauty, for a walk last March. Now, a verdict has been reached for one member of the husband-wife duo of assailants, though the charge is far less severe than it could have been.

The jury of 12 people found Saraya Sophia Lisa Gardner guilty on one count of obstruction of justice.

Her husband, 23-year-old George Allen Mason Jr. is accused of striking a gay man with a crowbar and hurling gay slurs at him March 1. The attacked happened at 185th and Evergreen next to a busy strip mall...

Gardner's attorney, Thomas Coan, said after the verdict that he and his client were a little bit surprised and disappointed by the verdict.

"We think the government didn't have the evidence necessary to prove Ms. Gardner's intent in this case," he said, adding that he believes some of the evidence presented in the case tainted the jury.

"There was evidence of homophobic slurs that we didn't think was relevant that could have tainted the jury or prejudiced the jury against Ms. Gardner," he said.

Beltier previously reported that he was "happy to be alive," and the trial for George Mason Jr., the physical assailant in this case, will likely begin soon.

  1. I would think that making slurs of any kind while striking someone with a crowbar would be relevant information for a jury to have.

  2. If you're in a state that allows you to carry guns; CARRY THEM! Otherwise always carry something on you that can be used as a weapon, even if it isn't technically...

    When someone charges you with a crowbar, baseball bat, whatever, BLOW THEIR F****** HEADS OFF or STAB THE S*** out of them or WHATEVER YOU CAN DO and get the HELL OUT.

    The police and justice system are NOT on our side. We need to take care of ourselves.

  4. @COMINGUP I'm very inclined to agree with you. The police and the justice system are definitely not on our side. Take no sh*t from anyone. Ever. Fight back. By whatever means necessary. And if you kill somebody defending yourself, it's a good thing.

  10. Her lawyer says there was no evidence of intent and then says that the evidence of intent (the homophobic slurs) shouldn't have been allowed. Pick one or the other, buddy. You can't have both.

  18. @clayton : the article said that her husband was the person making the slurs, so her attorney was arguing that the slurs were not relevant to her guilt or innocence. The judge allowed the slurs to be used as evidence, so one might presume that the attorney will use that decision by the judge as grounds for an appeal. That or something similar is the best option the attorney has - it is not like the facts are on his side.

  19. You don't always need a gun. had a friend from the means streets of Benton Harbor, MI. When we were walking back to our cars from the only gay bar around in Grand Rapids, MI in the '70s, he was always turning his head and looking for something when we talked; I asked him why. He said "I'm looking for a garbage can lid, a rock, a stick or something in case someone wants to attack us". Later, I learned to carry my car keys with the blade of the key sticking out between my fingers in case I got into a fight; or carry mace. But these things are for when you're cornered. The best thing to do (mostly because we're all a little loaded when we leave bars) is to run if you see someone chasing you or coming up to you.

  20. Oh, and need I add, when that particular horse face comes towards you. You can always tell when someone means to do you harm. They have an intent in their walk and face--they're not just walking down the street, but up to you.
