President Obama to Issue Executive Order Protecting LGBT Employees of Federal Contractors

Blue_obamaPresident Obama plans to sign an executive order protecting LGBT employees of federal contractors from discrimination.

A White House official has told Towleroad that the President has directed his staff to prepare the Order, which would build upon existing protections prohibiting federal contractors from discriminating  on the basis of race, color, religion, sex, or national origin.

The official cites the House's failure to act on ENDA as impetus for the order. Last year the Employment Non-Discrimination Act passed the Senate with bipartisan support but it has languished in the House, faced with Speaker John Boehner who has said there is no way he would bring it to a vote.

In March, 195 Democratic lawmakers sent a letter to Obama urging him to issue the Executive Order.

Said National Gay and Lesbian Task Force Executive Director Rea Carey in a statement sent via email:

“This is a major step forward in the struggle for freedom and justice for LGBTQ workers and their families. Now millions of people will have the economic security they need to provide for their families. Through his actions, the President has demonstrated again his commitment to ending discrimination. We thank all the organizations who have worked so hard to make this piece of history. This decision is good for LGBTQ people, good for our economy and good for America. Unfortunately, many of us who don't work for federal contractors will still lack workplace protections. Now we must redouble our efforts for the urgent passage of state employment protections and strong federal legislation.”

Obama is planning a trip to NYC in the coming days for an LGBT fundraiser.

The Administration only stopped defending DOMA as Constitutional after major gay donors closed their wallets. It took a while, but obviously resentment about his inexplicable failure-to-date to keep this promise was having a similar effect.

  14. Pressure on PBO has an effect, but it's wrong to dismiss the logic of waiting through this legislative session. Taking executive action early would have given Republicans a (stupid) excuse not to act on ENDA. Republicans caved on an inclusive Violence Against Women Act last year, so it wasn't totally crazy to keep all the pressure on them to take a vote in the House on this, too.

    As it stands now, the Republicans are exposed. Eight months after the Senate passed ENDA, they've done nothing.

    Don't get me wrong -- I'm thankful, thank you Mr. President -- but an awful lot of advocacy had to happen to get us to this inevitable point that could have been better spent elsewhere.

  20. Don't get too excited yet. They only leaked that an ENDA EO will be issued. They didn't release the text of the EO and the exemptions will be crucial. If it's like LBJ's EO, we're good, but I fear we may see generous "religious freedom" exemptions. The fact that they are sending this for drafting could indicate that this isn't a case of sexual orientation and gender identity simply being added to the existing provisions, but rather they are writing a separate order that is not as extensive. I hope that is not the case.

  22. Of course ENDA has been introduced 9 times in Congress and failed for various reasons. The most recent one is still waiting for a House vote which Boner has already said it won't happen this year. Probably an EO is the best one can get.

  23. Poor Simon and Crispy, twins attached at their heads....up Obama's ass. I have never not given him credit when he's done right. But no one has ever given a credible reason why he has not kept this promise. [And where are those now who said it wouldn't matter anyway?]

    Simply saying "better late than never" only further encourages him to believe he can do or not do what he wants re LGBTs with impunity. The timing of the announcement the day before the DNC's biggest fundraiser couldn't be more transparent. If their bean counting didn't show his failure to keep the six-year old promise wasn't negatively affecting fundraising for the midterms the announcement would have been simply saved as the Big Reveal at the White House Pride event June 30th.

    Too soon crispy critter Towleroadies chose to forget than no less than Andy Towle himself was one of those who boycotted the 2009 DNC LGBT fundraiser after the Obama DOJ defended DOMA using language even more homophobic than its authors did to pass it. Hagiography did hunt then, and it doesn't hunt today.
