Hate Crime Ruled Out in NY Bar Owner and Activist's Murder

An upcoming court hearing may provides some answers in the murder of gay Elmira, NY bar owner and activist Clinton “Billy” Lewis. An acquaintance, Louis Duffy, confessed to the crime.

Investigators have ruled out a hate crime in the murder: "'They've known each other for a short period of time,' said Captain Joseph Kain. 'A couple of weeks, a couple of months,' he added. How they knew each other isn't exactly clear."

  1. I know your legally system is somewhat complex,so bear with me.

Let me get this straight, unless you scream faggot and have witness's to see you scream faggot, then it's not a hate crime even though you killed that person because they were a 'faggot'?

It seems that I've noticed a pattern where police seem to try to not make any murder done to a gay person a 'hate crime' and it seems the courts as well.

Why is that? Is it because a lot of these states do not believe it exists?

It seems to me like it's a law that was brought on but yet every police team or courts go out of their way to make sure that no one is tried in a hate crime. Is it more costly?

Sorry, just really confused how this works.

It appears that, well I thought, many people wanted this hate crimes law but it seems everyone including the gay community are ignoring that at every stop, it is being prevented from being applied.

It's interesting because it shows the power of relentless and strategical lobbying with the Mathew Shepard foundation did.

Gay groups could learn from that woman and her team because this wasn't something that was even protested about or cared by gays but she would be damned if her sons memory would not be avenged.

  2. @Rowan,

Maybe it wasn't a 'hate' crime? Maybe it was two people, a disagreement, and violence that resulted in a death? Maybe Louis Duffy tried to rob the older man? Maybe they had a 'relationship' that soured?

  4. Well, as a person that lives in NYC, but is from Elmira and knew Bill, I think I may have a little insight into this. Bill was a good guy, but had a penchant for young, "thug" guys. All his friends tend to think that this was a trick gone awry. It fits every single pattern in his life. I tend to think that this should be looked at asa hate crime. They likely got together, the kid regretted it, and shot him. Plain and simple.

  5. Maybe we should wait for more details before passing judgment.
