Idaho Sheriff May Drop Boy Scouts Charter Because 'Sodomy is Against the Law'

Ben Wolfinger, the sheriff of Idaho's Kootenai County, says he may drop the Department's Boy Scouts of America charter because in dropping the ban on gay scouts the organization is promoting a lifestyle that is against state law, Coeur d'Alene Press reports:

Wolfinger"It would be inappropriate for the sheriff's office to sponsor an organization that is promoting a lifestyle that is in violation of state law," Sheriff Ben Wolfinger said.

Sodomy is against the law in Idaho, he added.

"I have talked with Chris Peterson about this and sent him a copy of the law," Wolfinger said.

Peterson, who works in the Hayden office of the Inland Northwest Council of Boy Scouts, could not be reached for comment on Friday, and Tim McCandless, CEO of the Inland Northwest Council, said he wanted to talk with the sheriff before commenting specifically to his concerns.

"I would encourage you to read the resolution that was passed, however." McCandless said. "Sodomy is not allowed in scouting and is not an issue in this discussion."

Somebody's been listening to too much Bryan Fischer.

    now, i was a boy scout in Canada so ...uh... maybe things are different, but last i checked being openly-gay didn't mean anything at all that had to do with...uh..."Sodomy"...

    unless he means the biblical term for Sodomy which is the hoarding of wealth and provisions and being inhospitable....

  6. What this highlights for me is that we need to get rid of the sodomy bans in the states that still have them on the books. 17 states still have sodomy bans in their state laws and they have been and still are being used as a means to discriminate.

    Furthermore, perhaps this not-quite-so-bright Idaho sheriff doesn't realize that state sodomy laws can't be enforced since they were repealed by action of the Supremes in their Lawrence v. Texas 2003 decision. Where has he been the last decade. I'm pretty sure this news has made it to Kootenai County, Idaho by now (even if Idaho state law remains quaintly unchanged). DUH!!!

    He needs to be arrested, tried and then sent to one of his own Idaho Prisons where he Obviously has no problem with...uh...Sodomy occuring on a reglar basis.

  12. My son was in boy scouts. I don't recall them ever having "Sodomy Nites." Nor was there a Sodomy Merit Badge. Maybe more lads would stay with the Scouts if they started having these things.

    Regarding your intention or consideration of dropping the Boy Scouts because of your state's sodomy law and your belief that homosexuality is illegal. Are you familiar with Lawrence v. Texas, 02-102? The 6-3 ruling reverses course from a ruling 17 years ago that states could punish homosexuals for what such laws historically called deviant sex. As a man of law, you should be familiar with Supreme Court cases and state sodomy laws; specifically those that outlaw same-sex acts between two consenting adults and the court decisions that found such laws unconstitutional. Yes it was a Texas law that was struck down but every constitutional scholar and law enforcement personnel across this country believe that the Supreme Court decision of Lawrence v. Texas, struck down all sodomy laws between two consenting adults pertaining to same sex acts.

    It is apparent that you have a problem with homosexuality and are hiding behind a misguided belief that your state still outlaws such relationships but that is simply not the case. Let us be honest, you find homosexuality abhorrent to your religious beliefs. You may have a sodomy law on the books, but it is unconstitutional and therefore not enforceable. But ultimately it is the voters in your county that will either affirm your belief or vote you out of office when the time comes. But thank you, for bringing your beliefs out into the open and showing that to be a sheriff, one doesn't really have to know the law...any law.
