Transgender Man Files Suit Against NYC, Says He Was Barred from Locker Room at Public Pool

Bryan John Ellicott sued the city of New York this week, claiming that Parks Department employees discriminated against him, violating his civil rights when they told him to use the women's locker room at Lyons Pool on Staten Island, or leave, the NY Daily News reports:

EllicottThe 24-year-old is currently transitioning from female-to-male, according to a lawsuit filed in Manhattan Supreme Court. Ellicott takes hormone replacements but hasn’t had sex-reassignment surgery yet, the suit said. He wore a t-shirt at the pool to cover up the binder he wears to compress his chest, the lawsuit said. But it wasn’t discreet enough to keep Parks Dept. employees from ordering him out, the suit claimed.

“You need to leave ... someone complained about someone being in the locker room who doesn’t belong here,” a Parks Dept. worker identified as Employee No. 1 told Ellicott, according to the suit.

Ellicott is idenitifed as male on his driver's license. He is also a city employee, working for the Office of Emergency Management.

The city has not commented on the suit, adds the NYDN:

The Parks Dept. declined to answer questions about its policies on public pool bathroom and facility usage. It referred all questions to the Law Dept.

“We will review the lawsuit when we are served,” a spokesman for the Law Dept. said Monday.

Ellicott, who chose his male name in honor of his father, a 9/11 first responder and city Emergency Medical Technician, is asking for unspecified damages.

He also wants to enjoin the Parks Dept. from future discrimination against transgender individuals seeking to use public facilities, the suit said.

    He (still anatomically a she) wants access to the locker room & the male shower which could pose a problem. If you allow him (still, technically a her) to have access to the male shower, other females should have access also. There's no other way around this. A man who still has a vagina should not be in the male locker room. A woman who still has a penis should not be allowed into the female locker room.

    From gay soldiers in the military to transgender people at a pool, people are so weirdly obsessed by bathrooms and lockerrooms, irrational fear and vivid imaginations fueling so many problems that shouldn't be a big deal.

    At what point does a "breast" become a "BREAST"? is it size? shape? perceived gender of the person?

  10. no T issues are not gay issues. No one bothered to ask any of us if we wanted be LGBT. For me the T now stands for THEM. Because its US and THEM. I am gay. Please don't refer to me by some acronym I would never use to describe myself.

    The issue here is that regardless of what she may think, other people think she is a female. That's the issue with trannys. They want to police what everyone else is suppose to think

  13. Will is correct...if this person has not had any surgeries yet, they have no business in that locker room. If surgery has taken place then by all means allow them. Use your common sense people...whats to prevent some predator...male or female, from crossdressing to obtain their goal. Thats why people have a problem with this issue.

    Kiwi...get a life...breasts are not the problem here. This is not someone to rally behind because their claim is warrantless and obviously a claim for their 15 mins of fame.

    because this isn't about genitalia. it's about gender. gender is between the ears, not the legs.

    if "JOHN" lost his micropenis, he'd still be a man. not a great man, but a man nonetheless. and i fail to see how this transman in the men's locker room is threat to these men....

    sorry, i agree with you on many things BUT on this you are wrong

    per science, gender is not between the ears

    xx chromosomes = MALE
    xy chromosomes = female

    there is no way to change such so at the very least the transgender should be required to have undergone the cosmetic (doesn't change hard science GENES) surgery

Moz - are you aware that some children transition? they don't have the surgeries, due to their ages, but they *do* indeed experience a gender-transition. are you saying that those children should be using the "bathrooms of their birth sex", even it if comes in conflict with their sense of self, their gender, and their gender-experssion?

    if so - congrats. you know too little. it's 2014 - no excuses for you to not learn more.

    my friend's 9 year old nephew has a boy in his class who is trans. and you know something amazing? all the kids accept him and understand him. and yes - he uses the boys room like all the other boys.

    There are teens in transition in schools, - pre-Op. that means they haven't had any surgeries yet, either. Amazingly, you don't care about them. Or the issues they face every day. the man in this story CLEARLY presents as MALE. you think it'd be totes chill for him to enter a ladies change room? yeah. right.
