Watch: NOM's Maggie Gallagher Responds to DOMA News - Obama Has 'Unilaterally Declared...Gay is Like Black'


FOX News phones up NOM's Maggie Gallagher to ask her what she thinks of the Attorney General's announcement that Obama has asked it to stop defending DOMA in court.

Gallagher says it's an end run around the Constitution and says Obama has "unilaterally declared that gay is like Black."

  1. Prior to becoming a reporter, Kelly earned J.D. from Albany Law School, where she also served as editor of the Albany Law Review. So unless she had a lobotomy, she's not really dumb or ignorant of the law. So she is playing dumb regarding the ramifications of this decision...She likely fully understands that through this decision alone, Texas wouldn't be forced to recognize a Mass marriage, but it's so much easier to fan the FOX NEWS flames of outrage when you play dumb. Their reporting is so dishonest on some many levels.

  4. Here's the relevant copy for Megyn's frenzied truthiness:

    "They're no longer going to be enforcing this federal law that's still on the books, passed by Congress, signed by President Clinton, and still very much a law."

    As others have commented, that's false. The Executive Branch will continue to enforce it unless it's repealed or overturned. You can see that in the DoJ's announcement and in the letter to Congress, sent from DoJ to Boehner.

    Holder to Boehner:
    "Notwithstanding this determination, the President has informed me that Section 3 will continue to be enforced by the Executive Branch. To that end, the President has instructed Executive agencies to continue to comply with Section 3 of DOMA, consistent with the Executive’s obligation to take care that the laws be faithfully executed, unless and until Congress repeals Section 3 or the judicial branch renders a definitive verdict against the law’s constitutionality. This course of action respects the actions of the prior Congress that enacted DOMA, and it recognizes the judiciary as the final arbiter of the constitutional claims raised. "

    DoJ announcement:
    "Section 3 of DOMA will continue to remain in effect unless Congress repeals it or there is a final judicial finding that strikes it down, and the President has informed me that the Executive Branch will continue to enforce the law. But while both the wisdom and the legality of Section 3 of DOMA will continue to be the subject of both extensive litigation and public debate, this Administration will no longer assert its constitutionality in court."

    With everything so clearly spelled out, it's shameful that a "news"caster would say otherwise.

  12. Megyn Kelly has a lot of disdain for someone who lives a dream job bitching about people. I've seen CNN anchors talk about abhorrent crimes with less disdain than this woman has shown to gays. Maybe it's that "y" in her name, it's kind of unseemly. I don't spell my name Myke.

  17. Why is it that organizations like Maggie Gallagher's always consider gays a threat to marriage, but never do anything about all the damage that hetero couples cause to it? It is the high rates of divorce, common-law marriage and out-of-wedlock births which have changed the marriage institution, not gays.

  21. "Maggie Gallagher of NOM went on Fox News to say that Obama declared unilaterally that gay is the same as black, which means that Obama is trivializing the Civil Rights Movement or something.

    Gallagher fudges the facts and says that Obama will require strict scrutiny in cases involving sexual orientation discrimination, which he didn't do - the letter Holder wrote only asks for ""more heightened scrutiny"" (so intermediate scrutiny like sex discrimination is held to is included). He also didn't ""unilaterally"" declare what level of scrutiny should be applied since he doesn't have that authority (nice implication there that he's an ""activist president,"" as if he wasn't elected); he made a recommendation that the court use a higher level of scrutiny but a court could always reject that.

    Oh, and Megan Kelly lied in saying that DOMA will no longer be enforced; Eric Holder specifically said that the Executive Branch would. Bonus points for chalking this all up to Obama's ""feelings"" (a standard-issue rightwing move that says that Obama's an irrational sob-sister) and for completely ignoring the numerous times Bush went to the Justice Department to get memos justifying whatever laws he wanted to break, including limits on torture and surveillance.
