Although Ms. Jackson was asked by SCOTUS to argue the point that neither BLAG nor the Administration have standing to appeal the Windsor DOMA decision, now having read her brief - I find she argues those positions quite competently. It was always clear that there's no standing in this case - but now I have a greater understanding of precisely why that is.

    I still think SCOTUS is going to reach the merits, and ignore the standing issue. But I cringe at that - because true justice demands that both the Prop 8 case AND the DOMA case be found to lack standing. In a perfect world - and not that I'm fond of any more delay - but in a perfect world, the Supreme Court would wait for "clean" cases on these issues that had legitimate standing.

  5. @Craig, the DOMA filing was expected. The court appointed someone to argue the idea that the case isn't eligible for a Supreme Court decision. The Constitution allows federal courts to hear only cases where there is a "controversy." In most cases, the side that won the appeal will try to argue that the Supreme Court can't hear the case, if such an argument presents itself. This case *does* present such an argument in theory, but neither side is raising it. Both parties involved--Edie Windsor v. the U.S.--agree that DOMA section III is unconstitutional. (There's a technical quibble with how the appellate court reached that decision, but everyone involved generally agrees with the overall consensus that DOMA sucks.) BUT both parties want the Supreme Court to rule so it can strike down the law nationwide. Until then, it will be valid in some places and not others. Since neither side is raising the standard argument that the court can't hear the case, the court itself appointed someone to make that argument. The news today is that the lawyer they appointed submitted her argument.

    On the other hand, she should try to undo the damage she's done to the public health by giving that nut Jenny McCarthy almost an hour of air time to try and convince people that vaccines are too dangerous.

  7. Frankly it's just as crucial to LGBT and many other rights that the GOP's gerrymandering be rules unconstitutional. Better yet, abandon the electoral college (like that will ever happen).
