A Load Of Trouble At New York City Gym

A man is suing Bally Total Fitness in New York City due to injuries he says he sustained after slipping on a "foreign white substance" in the steam room.

Reports the New York Daily News:

Marc Moskowitz claimed in court papers that managers at the Bally Total Fitness gym on E. 55th St. were aware that gay "cruising and lewd behavior" is "commonplace at the steam room, sauna and locker rooms."

"As a result of the aforementioned activities, there was bodily fluids and other evidence of sexual activity wherever it occurred throughout the gym," according to Moskowitz's suit in Manhattan Supreme Court.

Instead of having staffers clean the areas, Bally simply "left a hose and liquid soap" for people to clean up themselves, the papers state.

As a result, Moskowitz claims, he took a tumble last August and needed surgery to repair his shoulder.

The article goes on to describe the gym's review on the cruising website Cruising Gays City Hookup Guide: "There are 2 LIGHTS in the Steam Sauna. The rear light is out 1/2 the time. When it is OFF the party is ON."

  12. Really hate that moralizing conservative mentality that seems to define a very large portion of the gay community these days. Once upon a time Gays were in the vanguard of presenting alternative ways of living, of forming families, or creating communities. We seem now to be happy adapting hetero-normative ideas of morality, family and community. Once upon a time we celebrated how different we were. Now we seem to be all too happy to be as small and externally defined as everyone else.

  13. Assimilating into the culture (demanding marriage equality, non-discrimination in the workplace and all the rest) means WE DON'T GET TO USE EVERY PUBLIC PLACE AS A SEX STOP.

    We did it with parks, we did it with the YMCA, we did it with restrooms and gyms and adult "bookstores". We don't have to do this anymore! Have sex at home. The gyms and restrooms are not OURS to appropriate. Move out of 1960s thinking.

  14. Exactly how much of this foreign white substance was there? Most semen is pretty sticky, not slippery. Maybe the steam room somehow changed it, but this case sounds like it will be dismissed fairly readily---not least because he waited nearly a year to file it.

    I agree that gym sex is gross. Part of the reason I don't go to a gym. Oh, and I'm lazy.

Doing it in a public place makes us look cheap and certainly isn't "vanguard". Give me a break. It's called discretion, I suggest you get some.

  16. @Stuart, a hard-on is uncontrollable but what you do about that hard-on IS controllable. Please do not defend nasty, disrespectful, unhealthy behavior.

    Having respect for other people is not a 'narrow' morality, it is what allows society to function in spite of a variety of mores and quirks at large.

    I think the gym is at fault on general principle because of the hose and the soap. It is the gym's responsibility to ensure that its facilities are kept clean, and that its fixtures are kept in a proper state of repair. That cruising review is appalling.

    I go to the gym to work. I don't go to the gym for dangerous (and for the past 30 years, potentially fatal) unsafe sex. I don't go to the gym to watch others have dangerous potentially fatal unsafe sex. Do that kind of crap on your own time in private facility specifically geared to that.

    If Bally's wants to be that private facility specifically geared to that, more power to them -- but they are still going to need to follow basic health codes. That broken light, hose and soap is not following code. They need to also advertise officially that that's what they're about, so that the rest of us who want to work can seek places which will better cater to us.

  18. @Michaelandfred, I agree, it is highly unlikely that he saw a white substance on the floor of a darkened room. It is not unlikely, however, that he slipped.

    The gym appears to be of its own health code violations and safety violations, and hasn't done anything about them. There shouldn't be a darkened room in that gym in the first place. ESPECIALLY in a room meant to hold water. Where is maintenance?

    I agree with Alan, Jason, Jack and Jesse. And yes, this does need to stop.

  20. @excy, well gay men are going to have to get over it. The world does not revolve around gay men.

    Whatever the gay equivalent of 'oreo' is (straight drag?), gay men don't have to be afraid of becoming that. I think gay men should start to get serious about what a 'gay culture' means, though.

    Gay men are also going to have to accept that embracing actions which the larger straight society sees as detrimental will lead to conflict.

    Excy, if you want to embrace anonymous unsafe sex in public places as part of gay culture, then you are going to have fight for it and be ready to explain why anonymous unsafe sex in public places should be acceptable to the mainstream. And you are going to have to explain why it's acceptable to gay culture in the first place.

    You will have to go through the same thing the black community goes through. And, like with the black community, if some of those arguments seem less like common sense once they are aired in the light of day, then gay men will have to wrestle honestly with that, too.

  23. @excy, but I agree with you that gay men no longer have to do this -- the unsafe cruising -- anymore. I don't know about never having to do it, as I think back to the 50s. A private bathhouse catering exclusively to swinging gay men is always the answer.

    Bally's isn't it, though. Unless they want to switch up their advertising and mission statement. Nothing is preventing them from doing that. Maybe there is a need, and that need can be met. It needs to be met openly, though.
